T?RMINOS Y CONDICIONES DE BOLETOS PARA? WORLD BASEBALL CLASSIC
IMPORTANTE: ESTA ENTRADA ES UNA LICENCIA REVOCABLE; EL TITULAR ASUME VOLUNTARIAMENTE EL RIESGO DE ENFERMEDAD/LESIONES; NO HAY REINGRESO TRAS LA SALIDA; ESTA ENTRADA LIMITA LOS DERECHOS LEGALES DEL TITULAR
Al utilizar esta entrada, el titular de la entrada, en su propio nombre y en nombre de cualquier menor que lo acompa?e (en conjunto, el “Titular”), acepta los siguientes términos y condiciones (el “Acuerdo”), incluyendo un acuerdo para arbitrar y una renuncia a demandas colectivas. World Baseball Classic, Inc. (“WBCI”) puede cambiar los términos del Acuerdo en cualquier momento, sin previo aviso (“Actualizaciones del Acuerdo”), y el uso de esta entrada por parte del Titular después de que las Actualizaciones del Acuerdo se publiquen en /world-baseball-classic/tickets/terms significará que el Titular acepta dichas Actualizaciones del Acuerdo. El Titular es el único responsable de leer y comprender el Acuerdo antes de utilizar esta entrada. Para mayor claridad, en relación con cada término de este Acuerdo en el cual el Titular acepta realizar o abstenerse de realizar una acción, o concede derechos, dicho término obliga y vincula tanto al titular de la entrada como a cualquier menor que lo acompa?e. El titular de la entrada acepta, en nombre propio y de cualquier menor que lo acompa?e, que ambos cumplirán o se abstendrán de cumplir con dichas acciones o concederán tales derechos (según corresponda).
EXISTE UN RIESGO INHERENTE DE EXPOSICI?N A COVID-19 Y OTRAS ENFERMEDADES TRANSMISIBLES EN CUALQUIER LUGAR P?BLICO, SIN IMPORTAR LAS PRECAUCIONES QUE SE TOMEN. EL TITULAR, EN SU NOMBRE Y EN NOMBRE DE CUALQUIER ACOMPA?ANTE (SEG?N LA DEFINICI?N ABAJO), ACEPTA (A) ASUMIR TODOS LOS RIESGOS ASOCIADOS CON COVID-19 Y OTRAS ENFERMEDADES TRANSMISIBLES, Y (B) CUMPLIR CON TODAS LAS POL?TICAS RELACIONADAS DE SALUD Y SEGURIDAD DE WBCI.
El Titular acepta que: (a) no transmitirá ni ayudará a transmitir fotografías, imágenes, videos, audios, transmisiones en vivo u otros relatos o descripciones (incluyendo datos de jugada por jugada) (ya sea en texto, datos o visuales), en cualquier medio, de la totalidad o parte del juego para el cual esta entrada otorga admisión, o de cualquier entretenimiento, atracción, práctica, actividades de calentamiento, eventos previos, posteriores o entre innings, promociones o competencias ofrecidas en relación con el juego (el “Juego”) u otro evento (junto con el Juego, el “Evento”), incluyendo, entre otros, cualquier relato, descripción, imagen, video, audio, reproducción u otra información sobre el Juego u otro Evento (colectivamente, la “Información del Juego”); (b) WBCI es el propietario exclusivo de todos los derechos de autor y demás derechos de propiedad en el Juego y en la Información del Juego; y (c) WBCI, la Oficina del Comisionado de Béisbol, MLB Advanced Media, L.P., The MLB Network, LLC, los Clubes de Major League Baseball, Major League Baseball Properties, Inc., las federaciones nacionales de béisbol que participan en el World Baseball Classic, los jugadores y demás individuos que participan en el World Baseball Classic, la Asociación de Jugadores de Major League Baseball, MLB Players, Inc. y cada una de sus respectivas subsidiarias, afiliadas, agentes, oficiales, empleados, miembros, directores y propietarios, pasados, presentes y futuros (colectivamente, las “Entidades de WBCI”), y ciertos patrocinadores y licenciatarios actuales y futuros de dichas Entidades de WBCI, tendrán el derecho y la licencia sin restricciones para usar la imagen, semejanza, nombre, voz, comentarios y/o demás derechos de propiedad o públicos del Titular en cualquier transmisión, teletransmisión, fotografía, video, audio, grabación audiovisual y/u otras grabaciones en vivo o grabadas tomadas en relación con el Evento o en cualquier otra transmisión, distribución, presentación pública o reproducción parcial o total del Evento, para todos los propósitos, a nivel mundial, a perpetuidad y en cualquier medio actualmente conocido o que pueda existir en el futuro, sin compensación alguna. Los derechos otorgados en este documento a las Entidades de WBCI son transferibles.
El Titular, en su propio nombre y en nombre de cualquier Persona que lo Acompa?e (según se define al final de este párrafo), (a) consiente a revisiones, inspecciones y/o registros de seguridad sobre su persona, bolsas, vestimenta u otros artículos, así como los de cualquier Persona que lo Acompa?e, ya sea mediante detectores de metales, revisión manual de bolsas u otros medios; y (b) reconoce y acepta cumplir con (i) todas las políticas y protocolos pertinentes emitidos por cualquier Entidad de WBCI, incluyendo, entre otros, cualquier política o protocolo relacionado con seguridad, bolsas, conducta de los aficionados y/o salud y seguridad (cada una, una “Política” y colectivamente, las “Políticas”), las cuales pueden actualizarse periódicamente desde la compra de esta entrada hasta la fecha del Evento, y (ii) todas las leyes, órdenes y políticas aplicables de autoridades nacionales y locales (subsecciones (i) y (ii), conjuntamente, “Reglas de Salud y Seguridad”). El Titular reconoce que las Entidades de WBCI no asumen responsabilidad alguna por la persona o propiedad del Titular y/o de cualquier Persona que lo Acompa?e. Una “Persona que Acompa?a” es cualquier persona que acompa?e al Titular (que no sea un menor) para quien el Titular haya adquirido una entrada para asistir al Evento junto con él (cada uno de los cuales autoriza al Titular a aceptar los términos aplicables del Acuerdo en su nombre) (colectivamente, las “Personas que Acompa?an”).
Las Entidades de WBCI se reservan el derecho de terminar la licencia otorgada por esta entrada, por cualquier motivo, mediante el reembolso al Titular del precio de compra impreso en esta entrada. Asimismo, las Entidades de WBCI se reservan el derecho, sin reembolso de ninguna parte del precio de compra, de revocar cualquiera o todas las licencias otorgadas por esta entrada y de negar la admisión o expulsar del Evento al Titular y a cualquier Persona que lo Acompa?e si alguna de estas personas: (a) viola los términos del Acuerdo, incluyendo, entre otros, cualquier Política; (b) está en posesión de cualquier objeto que las Entidades de WBCI consideren potencialmente peligroso, inapropiado y/o perjudicial para otros asistentes (colectivamente, “Objetos Prohibidos”), y dichos Objetos Prohibidos podrán ser confiscados; (c) parece estar o está intoxicado; (d) se comporta de manera considerada inadecuada, desordenada o impropia por alguna de las Entidades de WBCI; (e) usa lenguaje vulgar o abusivo; o (f) representa un riesgo para la salud o seguridad de otros.
El Titular asume todos los riesgos asociados con la compra de esta entrada de cualquier persona que no sea WBCI o sus agentes designados. Esta entrada no puede usarse para publicidad, promociones (incluyendo concursos y sorteos) u otros fines comerciales sin el consentimiento expreso por escrito de WBCI. No se permite ofrecer en reventa o revender esta entrada en la medida en que esté prohibido por cualquier ley o regulación aplicable o en violación de cualquier Política. Cualquier reventa de esta entrada invalidará la licencia otorgada por esta entrada. Esta entrada no puede revenderse ni ofrecerse para reventa dentro del lugar anfitrión, incluyendo el estadio, los terrenos aleda?os y las áreas de estacionamiento (colectivamente, el “Lugar Anfitrión”), y cualquier persona que venda u ofrezca esta entrada para reventa a cualquier precio dentro del Lugar Anfitrión será expulsada del recinto y podrá ser procesada legalmente.
El Titular, en su propio nombre y en nombre de cualquier Persona que lo Acompa?e, acepta cumplir con todos los términos y condiciones presentados al momento de la compra de esta entrada y no específicamente enumerados aquí, incluyendo, entre otros, (a) términos que limiten la cantidad de entradas que pueden ser compradas, (b) requisitos adicionales respecto a las Personas que Acompa?an, y (c) términos relativos a la reventa o transferencia de entradas.
PROMESA DE SALUD DEL AFICIONADO
El Titular reconoce y entiende que, si se infecta con COVID-19 u otra Enfermedad Transmisible (según se define al final de este párrafo), el Titular y/o cualquier Persona que lo Acompa?e podría contagiar a otras personas con las que luego entre en contacto, incluso si no presenta síntomas de enfermedad, y que el riesgo de exposición para otros siempre está presente. En consecuencia, el Titular acepta que ni él ni ninguna Persona que lo Acompa?e asistirán al Evento si, en la fecha del Evento, las Reglas de Salud y Seguridad les requieren o recomiendan permanecer en casa, en cuarentena y/o aislamiento (por ejemplo, como resultado de dar positivo, presentar síntomas o haber tenido contacto directo con alguien que dio positivo a COVID-19 u otra Enfermedad Transmisible). Una “Enfermedad Transmisible” se refiere aquí a COVID-19, cualquier cepa, variante o mutación de esta, el coronavirus que causa COVID-19, y/o cualquier otra enfermedad, virus, bacteria o causa de enfermedades transmisibles por el aire, en aerosoles o en superficies.
ASUNCI?N DE RIESGOS RELACIONADOS CON COVID-19 Y OTRAS ENFERMEDADES TRANSMISIBLES
El Titular, en su propio nombre y en nombre de cualquier Persona que lo Acompa?e, reconoce y asume de manera expresa y voluntaria todos los riesgos que de cualquier forma están relacionados con, o surgen de, la exposición o el contagio de COVID-19 u otra Enfermedad Transmisible en el Lugar Anfitrión. Al utilizar esta entrada, el Titular está reconociendo y confirmando, en su propio nombre y en nombre de cualquier Parte Relacionada (según se define al final de este párrafo), tanto ahora como en el futuro, que entiende y asume expresamente el riesgo de que el Titular y/o cualquier Persona que lo Acompa?e puedan exponerse a COVID-19 u otra Enfermedad Transmisible. El Titular entiende expresamente que estos riesgos incluyen el contagio de COVID-19 u otra Enfermedad Transmisible y los peligros asociados, complicaciones médicas y lesiones físicas y mentales, tanto previsibles como imprevisibles, que pueden resultar del contagio de COVID-19 u otra Enfermedad Transmisible. Además, el Titular reconoce y entiende, en su propio nombre y en nombre de cualquier Persona que lo Acompa?e: que cualquier interacción con el público en general conlleva un riesgo inherente de exposición y contagio de Enfermedades Transmisibles, incluyendo, entre otras, COVID-19; que no se puede garantizar que el Titular y/o cualquier Persona que lo Acompa?e no se expondrán; y que, por lo tanto, la exposición potencial o el contagio de COVID-19 u otra Enfermedad Transmisible son riesgos inherentes en la decisión del Titular de usar esta entrada y no pueden ser eliminados. Las “Partes Relacionadas” incluyen a cualquier Persona que lo Acompa?e, así como a los representantes personales del Titular y de cualquier Persona que lo Acompa?e, asignados, herederos, familiares cercanos y cualquier otra persona o entidad que tenga derecho a presentar un reclamo en su nombre.
ASUNCI?N DE RIESGO DE LESIONES PERSONALES, ENFERMEDAD Y/O DA?OS A LA PROPIEDAD
El Titular reconoce que la asistencia del Titular y cualquier Persona que lo Acompa?e al Evento es voluntaria y puede resultar en lesiones personales (incluyendo la muerte), enfermedades y/o da?os a la propiedad. El Titular acepta cumplir con todas las Políticas, mantenerse alerta y estar consciente de su entorno y del entorno de cualquier Persona que lo Acompa?e. Al utilizar esta entrada o asistir, observar o participar en el Evento, el Titular, en su propio nombre y en nombre de cualquier Parte Relacionada, reconoce y asume todos los riesgos y peligros asociados con: (a) ser espectador antes, durante y después de un juego de béisbol (incluyendo calentamientos, prácticas, actividades previas, posteriores y entre innings, promociones y competencias), y (b) asistir, observar o participar en el Evento, en cada caso, ya sea que tal riesgo o peligro ocurra antes, durante o después, incluyendo específicamente (aunque no exclusivamente) el peligro de ser lesionado por bates lanzados, fragmentos de bate, pelotas lanzadas o bateadas, objetos lanzados, caídos o impulsados, proyectiles, personas, animales, otros peligros o distracciones, y cualquier incidente o accidente asociado con multitudes o la negligencia o mala conducta de otros espectadores. El Titular, en su propio nombre y en nombre de cualquier Parte Relacionada, acepta que las Partes Liberadas (según se define al final de este párrafo) no serán responsables de ninguna lesión personal (incluyendo la muerte), enfermedad, da?o a la propiedad u otra pérdida sufrida como resultado de (x) la participación, asistencia y/o observación del Titular y/o de cualquier Persona que lo Acompa?e en el Evento, y/o (y) la negligencia exclusiva, conjunta o comparativa, o la responsabilidad estricta de cualquiera de las Partes Liberadas (colectivamente, las “Reclamaciones del Espectador”). Las “Partes Liberadas” son: (i) las Entidades de WBCI, (ii) cada uno de los licenciatarios, patrocinadores y proveedores actuales, pasados y futuros de las Entidades de WBCI, así como todos sus sucesores y cesionarios, (iii) todas las demás entidades relacionadas con el World Baseball Classic, (iv) el Lugar Anfitrión y sus propietarios y/o operadores, (v) cualquier entidad gubernamental asociada con el Lugar Anfitrión, (vi) el proveedor o vendedor de entradas, y (vii) todas las afiliadas actuales, pasadas y futuras, sucesores, cesionarios, jugadores, managers, coaches, empleados, socios, miembros, directores, oficiales, propietarios, agentes, representantes y contratistas independientes de dichas entidades.
LIBERACI?N GENERAL DE RESPONSABILIDAD Y ACUERDO DE NO DEMANDAR
EN SU PROPIO NOMBRE Y EN NOMBRE DE CUALQUIER PARTE RELACIONADA, EL TITULAR RENUNCIA, LIBERA, DESCARGA, INDEMNIZA Y ACUERDA NO DEMANDAR A LAS PARTES LIBERADAS CON RESPECTO A CUALQUIER RECLAMO, RESPONSABILIDAD O DEMANDA DE CUALQUIER TIPO O NATURALEZA, YA SEA EN DERECHO O EQUIDAD, QUE PUEDA SURGIR EN RELACI?N CON, O TENGA ALGUNA RELACI?N CON, (A) EL USO DE ESTA ENTRADA, (B) LA PRESENCIA EN EL LUGAR ANFITRI?N O (C) LA PARTICIPACI?N EN EL EVENTO O CUALQUIER ACTIVIDAD RELACIONADA ORGANIZADA, PROMOVIDA Y/O PATROCINADA POR LAS PARTES LIBERADAS, INCLUYENDO, ENTRE OTROS, AQUELLOS RECLAMOS QUE SURJAN COMO RESULTADO DE: (I) TOTAL O PARCIALMENTE, LA NEGLIGENCIA EXCLUSIVA, CONJUNTA O COMPARATIVA, O RESPONSABILIDAD ESTRICTA, DE LAS PARTES LIBERADAS, Y/O (II) LOS RIESGOS INHERENTES ASOCIADOS CON VISITAR EL LUGAR ANFITRI?N, INCLUYENDO, ENTRE OTROS, (a) TODAS LAS RECLAMACIONES DEL ESPECTADOR; (b) TODAS LAS RECLAMACIONES POR LESIONES PERSONALES, MUERTE INJUSTA O EXPOSICI?N O CONTAGIO DE COVID-19 U OTRA ENFERMEDAD TRANSMISIBLE DEL TITULAR, CUALQUIER PERSONA QUE LO ACOMPA?E U OTRAS PERSONAS EXPUESTAS A COVID-19 U OTRA ENFERMEDAD TRANSMISIBLE POR EL TITULAR O CUALQUIER PERSONA QUE LO ACOMPA?E; (c) TODAS LAS RECLAMACIONES EN RELACI?N CON CUALQUIER REVISI?N O INSPECCI?N DE SEGURIDAD, O LA APLICACI?N DE CUALQUIER REGLA DE SALUD Y SEGURIDAD AL TITULAR Y/O A CUALQUIER PERSONA QUE LO ACOMPA?E; Y/O (d) TODAS LAS RECLAMACIONES POR INVASI?N DE PRIVACIDAD, DIFAMACI?N, VIOLACI?N DE CUALQUIER DERECHO DE PUBLICIDAD, DERECHO A LA PRIVACIDAD O CUALQUIER OTRA CAUSA DE ACCI?N DERIVADA DE LA PRODUCCI?N, REPRODUCCI?N, DISTRIBUCI?N, TRANSMISI?N, PUBLICACI?N, EJECUCI?N P?BLICA, DIFUSI?N O EXHIBICI?N DE ANUNCIOS, PROMOCIONES, CONTENIDO, PROGRAMAS Y/O MATERIALES EN LOS QUE APAREZCAN GRABACIONES O FOTOGRAF?AS DEL TITULAR O CUALQUIER PERSONA QUE LO ACOMPA?E DEL EVENTO (COLECTIVAMENTE, LAS “RECLAMACIONES LIBERADAS”).
Las aceptaciones y asunciones expresas de riesgos, renuncias de reclamaciones y liberaciones de responsabilidad contenidas en el presente documento están destinadas a ser vinculantes y constituyen renuncias completas de reclamaciones y liberaciones de responsabilidad, y deben interpretarse de manera amplia e inclusiva en la medida en que la ley lo permita, incluyendo cualquier controversia, reclamación o disputa que pueda surgir relacionada con la exposición o el contagio de COVID-19 u otra Enfermedad Transmisible. Si alguna parte de este documento se considera inválida o legalmente inaplicable por cualquier motivo (la “Disposición Afectada”), el resto del Acuerdo no se verá afectado y permanecerá válido y plenamente aplicable, y la Disposición Afectada se aplicará en la máxima medida permitida por la ley.
AL ASISTIR Y/O PARTICIPAR EN EL EVENTO, SE CONSIDERA QUE EL TITULAR, EN SU PROPIO NOMBRE Y EN NOMBRE DE CUALQUIER PARTE RELACIONADA, HA OTORGADO UNA LIBERACI?N COMPLETA DE RESPONSABILIDAD A LAS PARTES LIBERADAS HASTA EL M?XIMO PERMITIDO POR LA LEY.
SI ASISTEN MENORES Y/O OTRAS PERSONAS QUE ACOMPA?AN AL TITULAR AL EVENTO, SE CONSIDERA QUE EL TITULAR HA OTORGADO TODOS LOS DERECHOS, LIBERACIONES Y RENUNCIAS ANTERIORES EN NOMBRE DE: (A) DICHOS MENORES COMO PADRE O TUTOR O COMO AGENTE AUTORIZADO DE SU PADRE O TUTOR; Y/O (B) TALES OTRAS PERSONAS QUE LO ACOMPA?AN, COMO SU AGENTE AUTORIZADO. SI EL TITULAR NO DESEA OTORGAR, O NO EST? AUTORIZADO PARA OTORGAR, DICHOS DERECHOS, LIBERACIONES Y RENUNCIAS EN NOMBRE DE: (I) TALES MENORES, EL TITULAR DEBER? SALIR INMEDIATAMENTE DEL LUGAR ANFITRI?N CON DICHOS MENORES; Y/O (II) CUALQUIER OTRA PERSONA QUE LO ACOMPA?E, TAL PERSONA QUE ACOMPA?A DEBER? SALIR INMEDIATAMENTE DEL LUGAR ANFITRI?N.
El Titular indemnizará, defenderá y eximirá de responsabilidad a las Partes Liberadas de y contra cualquier demanda, pleito, reclamación, costo (incluidos honorarios y gastos razonables de abogados), gastos y responsabilidades que surjan, sean incidentales o estén relacionados de cualquier manera con (i) Reclamaciones Liberadas, (ii) los actos u omisiones del Titular y/o de cualquier Persona que lo Acompa?e, o (iii) el incumplimiento por parte del Titular de cualquiera de los términos, condiciones o declaraciones hechas en el Acuerdo.
EL TITULAR ACEPTA QUE LAS OBLIGACIONES DE INDEMNIZACI?N Y RESPONSABILIDADES ASUMIDAS AQU? SON SIN L?MITE Y SIN CONSIDERACI?N DE LA CAUSA O CAUSAS DE LAS MISMAS, INCLUYENDO LA NEGLIGENCIA EXCLUSIVA, CONJUNTA O CONCURRENTE DE CUALQUIER PARTE LIBERADA, YA SEA ACTIVA O PASIVA, RESPONSABILIDAD ESTRICTA, DEFECTOS O CONDICIONES LATENTES, PATENTES O PREEXISTENTES, Y TAMBI?N INCLUYENDO CUALQUIER RECLAMO QUE SURJA DE LA ENTRADA, SALIDA, CARGA Y DESCARGA DE PERSONAL O CARGA.
ENTRAR AL TERRENO DE JUEGO DURANTE UN PARTIDO, INTERRUMPIR DE OTRO MODO UN EVENTO Y/O INTENTAR CUALQUIER CONTACTO F?SICO CON UN PARTICIPANTE DEL EVENTO ES UN DELITO SANCIONABLE CON MULTA Y/O PRISI?N. LOS INFRACTORES PODR?N SER PROCESADOS EN LA M?XIMA MEDIDA PERMITIDA POR LA LEY.
ACUERDO DE ARBITRAJE OBLIGATORIO Y RENUNCIA A DEMANDAS COLECTIVAS (“ACUERDO DE ARBITRAJE”)
Las Entidades de WBCI valoran profundamente mantener buenas relaciones con los aficionados. Si usted o alguna Persona que lo Acompa?e tiene un problema con esta entrada o el Evento, una llamada al servicio al cliente podría resolver el asunto de manera rápida y amistosa. Cualquier disputa que no se resuelva informalmente deberá resolverse conforme a este Acuerdo de Arbitraje.
A menos que esté prohibido por la ley aplicable, el Titular y las Entidades de WBCI acuerdan someter a arbitraje todas las reclamaciones y disputas relacionadas de alguna manera con la compra de esta entrada, el uso de esta entrada por parte del Titular o de cualquier Persona que lo Acompa?e, la participación, asistencia y/u observación del Evento por parte del Titular y/o cualquier Persona que lo Acompa?e, el Acuerdo y cualquier trato relacionado entre ellos, incluyendo, sin limitación, reclamaciones por enfermedad (incluyendo COVID-19 u otra Enfermedad Transmisible), lesiones corporales o da?os a la propiedad derivados de la asistencia y/o participación del Titular y/o de cualquier Persona que lo Acompa?e en el Evento (“Reclamaciones de Arbitraje”), excepto por Reclamaciones de Arbitraje sobre la validez, alcance o aplicabilidad de este Acuerdo de Arbitraje, mediante ARBITRAJE INDIVIDUAL VINCULANTE.
En cualquier Reclamación de Arbitraje que se resuelva mediante arbitraje, ni el Titular ni las Entidades de WBCI podrán tener un juicio con jurado ni participar en una demanda colectiva o en un arbitraje colectivo. Otros derechos que el Titular y las Entidades de WBCI tendrían en un tribunal no estarán disponibles o estarán más limitados en el arbitraje, incluyendo el derecho a apelar. Tanto el Titular como las Entidades de WBCI entienden y acuerdan que, al requerir que todas las disputas se resuelvan mediante arbitraje individual, RENUNCIAMOS AL DERECHO A UN JUICIO CON JURADO. TODAS LAS DISPUTAS SE SOMETER?N A ARBITRAJE DE MANERA INDIVIDUAL Y NO COMO DEMANDA COLECTIVA, ACCI?N REPRESENTATIVA, ARBITRAJE COLECTIVO O CUALQUIER PROCEDIMIENTO SIMILAR. Los árbitros no podrán consolidar las reclamaciones de múltiples partes.
El arbitraje será administrado por una entidad de arbitraje reconocida y seleccionada por WBCI. El arbitraje se llevará a cabo en la ciudad donde se encuentra el Lugar Anfitrión. El procedimiento de arbitraje será presidido por un solo árbitro, quien será seleccionado de acuerdo con las normas que, según lo especificado anteriormente, regirán el arbitraje. El árbitro estará autorizado para otorgar cualquier reparación que hubiera estado disponible en un tribunal, siempre que la autoridad del árbitro esté limitada exclusivamente al Titular y a las Entidades de WBCI, excepto cuando se indique específicamente lo contrario en el presente documento. Ninguna decisión arbitral tendrá efecto excluyente sobre terceros. La decisión del árbitro será final y vinculante. Las partes acuerdan que este Acuerdo de Arbitraje se extiende a cualquier otra parte involucrada en cualquier Reclamación de Arbitraje, incluyendo, entre otros, Personas que Acompa?an, Partes Relacionadas y/o Partes Liberadas. En caso de conflicto, este Acuerdo de Arbitraje prevalecerá sobre las normas de la entidad de arbitraje o del árbitro.
Sin perjuicio de cualquier otra disposición aquí establecida, tanto el Titular como las Entidades de WBCI podrán ejercer cualquier derecho legal para buscar medidas provisionales, sin renunciar por ello al derecho a arbitrar. No obstante cualquier otra disposición del Acuerdo, si se determina que la renuncia a demandas colectivas y la prohibición de arbitraje colectivo son inválidas o inaplicables, entonces este Acuerdo de Arbitraje en su totalidad será nulo. Si alguna parte de este Acuerdo de Arbitraje, aparte de la renuncia a demandas colectivas y la prohibición de arbitraje colectivo, se considera inválida o inaplicable, ello no invalidará las disposiciones restantes de este Acuerdo de Arbitraje. Este Acuerdo de Arbitraje sobrevivirá a la terminación del Acuerdo, la conclusión del Evento, y/o la bancarrota o insolvencia de una de las partes (en la medida permitida por la ley aplicable).
USTED TIENE EL DERECHO DE RECHAZAR ESTE ACUERDO DE ARBITRAJE, PERO DEBE EJERCER ESTE DERECHO PRONTAMENTE. Si el Evento avanza hasta o más allá del punto que constituye un Juego Reglamentario, no se emitirán reembolsos.

WORLD BASEBALL CLASSIC TICKET TERMS & CONDITIONS
IMPORTANT: THIS TICKET IS A REVOCABLE LICENSE; HOLDER VOLUNTARILY ASSUMES RISK OF ILLNESS/INJURY; NO RE-ENTRY UPON EXIT; THIS TICKET LIMITS HOLDER’S LEGAL RIGHTS
By using this ticket, ticket holder, on their own behalf and on behalf of any accompanying minor (together, “Holder”), agrees to the following terms and conditions (the “Agreement”), including an AGREEMENT TO ARBITRATE AND A CLASS ACTION WAIVER. World Baseball Classic, Inc. (“WBCI”) may change the terms of the Agreement at any time, without notice (“Agreement Updates”), and Holder’s use of this ticket after Agreement Updates are posted at /world-baseball-classic/tickets/terms will mean that Holder accepts such Agreement Updates. Holder is solely responsible for reading and understanding the Agreement before using this ticket. For the sake of clarity, with regard to each term of this Agreement in which Holder agrees to take or refrain from an action or grants rights, such term shall and does bind the ticket holder and any accompanying minor to, and ticket holder shall cause such accompanying minor to, take or refrain from such action and to grant such rights, such that the ticket holder is agreeing, on behalf of ticket holder and any accompanying minor, that ticket holder and such minor will take or refrain from such action or grant such rights (as applicable).
AN INHERENT RISK OF EXPOSURE TO COVID-19 AND OTHER COMMUNICABLE DISEASES EXISTS IN ANY PUBLIC PLACE REGARDLESS OF PRECAUTIONS THAT MAY BE TAKEN. HOLDER, ON THEIR BEHALF AND ON BEHALF OF ANY ACCOMPANYING PARTIES (AS DEFINED BELOW), AGREES TO (A) ASSUME ALL RISKS ASSOCIATED WITH COVID-19 AND OTHER COMMUNICABLE DISEASES, AND (B) COMPLY WITH ALL RELATED HEALTH & SAFETY POLICIES OF WBCI.
Holder agrees that: (a) Holder will not transmit or aid in transmitting any photographs, images, videos, audio, livestreams or other accounts or descriptions (including play-by-play data) (whether text, data or visual), in any media, of all or any part of the game to which this ticket grants admission or any entertainment, attractions, warm-ups, practices, pre-game, post-game or between-inning activities, promotions or competitions offered in connection with the game (the “Game”) or any other event (collectively with the Game, the “Event”) including, but not limited to, any account, description, picture, video, audio, reproduction or other information concerning the Game or other Event (collectively, the “Game Information”); (b) WBCI is the exclusive owner of all copyrights and other proprietary rights in the Game and the Game Information; and (c) WBCI, the Office of the Commissioner of Baseball, MLB Advanced Media, L.P., The MLB Network, LLC, the Clubs of Major League Baseball, Major League Baseball Properties, Inc., the national baseball federations participating in the World Baseball Classic, the players and other individuals participating in the World Baseball Classic, Major League Baseball Players Association, MLB Players, Inc. and each of their respective past, present and future subsidiaries, affiliates, agents, officers, employees, members, directors and owners (collectively, the “WBCI Entities”), and certain current and future sponsors and licensees of such WBCI Entities, will have the unrestricted right and license to use Holder’s image, likeness, name, voice, comments and/or other proprietary or public rights in any live or recorded broadcast, telecast, photograph, video, audio, audiovisual and/or other recording taken in connection with the Event or other transmission, distribution, public performance, or reproduction in whole or in part of the Event, for all purposes, worldwide, in perpetuity, and in any and all media now or hereafter known, without compensation. The rights granted herein to the WBCI Entities are assignable.
Holder, on their own behalf and on behalf of any Accompanying Parties (as defined at the conclusion of this paragraph), (a) consents to security searches, screenings and/or inspection of Holder’s and/or any Accompanying Parties’ person, bags, clothing, or other articles for security purposes, whether by walk-through metal detection, handheld metal detection, bag checks or otherwise; and (b) acknowledges and agrees to comply with (i) all relevant policies and protocols issued by any WBCI Entity, including, without limitation, any policies and protocols regarding security, bags, fan conduct and/or health and safety (each, a “Policy” and collectively, the “Policies”), all of which may continue to be updated from time to time between purchase of this ticket and the Event date, and (ii) all applicable laws, orders and policies of national and local authorities (subsections (i) and (ii) are, collectively, “Health and Safety Rules”). Holder acknowledges that the WBCI Entities have no liability for Holder’s and/or any Accompanying Parties’ person or property. An “Accompanying Party” is any accompanying party (other than accompanying minors) for whom Holder retains a ticket to attend the Event with Holder (each of whom Holder represents have authorized Holder to act on their behalf in accepting the applicable Agreement terms) (collectively, the “Accompanying Parties”).
The WBCI Entities reserve the right to terminate the license granted by this ticket, for any reason, by tendering to Holder the purchase price printed on this ticket. Further, the WBCI Entities reserve the right, without refund of any portion of such purchase price, to revoke any or all license(s) granted by this ticket and refuse admission to, or eject from, the Event, Holder and any Accompanying Parties if any such person: (a) violates the terms of the Agreement, including without limitation any Policy; (b) is in possession of any item or object that the WBCI Entities consider potentially dangerous, hazardous, inappropriate and/or injurious to other patrons (collectively, “Prohibited Items), and any such Prohibited Items may be confiscated; (c) appears to be or is intoxicated; (d) engages in conduct deemed by any of the WBCI Entities to be improper, disorderly or unbecoming; (e) uses vulgar or abusive language; or (f) poses a risk to the health or safety of others.
Holder assumes all risk associated with the purchase of this ticket from anyone other than WBCI or its designated agents. This ticket may not be used for advertising, promotion (including contests and sweepstakes), or other trade or commercial purposes without the express written consent of WBCI. No offer to resell or resale of this ticket is permitted to the extent prohibited by any applicable law or regulation or in violation of any Policy. Any such resale will invalidate the license granted by this ticket. This ticket may not be resold or offered for resale inside the host venue, including the ballpark, surrounding grounds and parking areas (collectively, the “Host Venue”), and any person who sells or offers this ticket for resale at any price inside the Host Venue will be removed from the premises and may be prosecuted.
Holder, on their behalf and on behalf of any Accompanying Parties, agrees to comply with all terms and conditions presented at the time of purchase of this ticket not specifically enumerated herein, including without limitation (a) terms that mandate or prescribe the quantity of tickets available to be purchased, (b) additional requirements regarding Accompanying Parties, and (c) terms regarding the resale or transfer of tickets.
FAN HEALTH PROMISE
Holder acknowledges and understands that, if infected with COVID-19 or other Communicable Disease (as defined at the conclusion of this paragraph), Holder and/or any Accompanying Parties may infect others that they may subsequently come in contact with, even if they are not experiencing or displaying any symptoms of illness, and that the risk of exposure to others remains at all times. Accordingly, Holder agrees that neither Holder nor any Accompanying Party will attend the Event if, on the date of the Event, they are required or recommended by Health and Safety Rules to stay at home, quarantine and/or isolate (e.g., as a result of testing positive for, experiencing symptoms of, or being in direct contact with someone who tested positive for, COVID-19 or other Communicable Disease). A “Communicable Disease” as used herein is COVID-19, any strains, variants, or mutations thereof, the coronavirus that causes COVID-19, and/or any other airborne, aerosolized or surface transmissible communicable and/or infectious diseases, viruses, bacteria or illnesses or the causes thereof.
ASSUMPTION OF RISK RELATED TO COVID-19 AND OTHER COMMUNICABLE DISEASES
Holder, on their behalf and on behalf of any Accompanying Parties, acknowledges, and expressly and voluntarily assumes all risks that are in any way related to or arising from being exposed to or contracting COVID-19 or other Communicable Disease in the Host Venue. By using this ticket, Holder is acknowledging and confirming, on behalf of Holder and any Related Parties (as defined at the conclusion of this paragraph) both now and in the future, that Holder understands and expressly assumes the risk that Holder and/or any Accompanying Parties may be exposed to COVID-19 or other Communicable Disease. Holder expressly understands that these risks include contracting COVID-19 or other Communicable Disease and the associated dangers, medical complications and physical and mental injuries, both foreseen and unforeseen, that may result from contracting COVID-19 or other Communicable Disease. Holder further acknowledges and understands, on their own behalf and on behalf of any Accompanying Parties: that any interaction with the general public poses an inherent risk of being exposed to and contracting Communicable Disease, including, but not limited to, COVID-19; that it cannot be guaranteed that Holder and/or any Accompanying Parties will not be exposed; and that as such, potential exposure to or contraction of COVID-19 or other Communicable Disease are risks inherent in Holder’s decision to use this ticket and cannot be eliminated. “Related Parties” are any Accompanying Parties as well as Holder’s and any Accompanying Parties’ personal representatives, assigns, heirs, next of kin and any other person or entity that may be entitled to make a claim on their behalf.
ASSUMPTION OF RISK OF PERSONAL INJURY, ILLNESS AND/OR PROPERTY DAMAGE
Holder recognizes that attendance of Holder and any Accompanying Parties at the Event is voluntary and may result in personal injury (including death), illness and/or property damage. Holder agrees to abide by all Policies and to stay alert and remain aware of Holder’s surroundings and the surroundings of any Accompanying Parties. By using this ticket or by attending, observing or participating in the Event, Holder, on their own behalf and on behalf of any Related Parties, acknowledges and assumes all risks and dangers associated with: (a) being a spectator before, during, and after a baseball game (including all warm-ups, practices, pre-game, post-game and between-inning activities, promotions and competitions), and (b) attending, observing or participating in the Event, in each case, whether any such risk or danger occurs prior to, during or subsequent thereto, including specifically (but not exclusively) the danger of being injured by thrown bats; bat fragments; thrown or batted balls; thrown, dropped, or launched items; projectiles; persons; animals; other hazards or distractions; and any incidents or accidents associated with crowds of people or the negligence or misconduct of other spectators. Holder, on their behalf and on behalf of any Related Parties, agrees that the Released Parties (as defined at the conclusion of this paragraph) will not be responsible for any personal injury (including death), illness, property damage, or other loss suffered as a result of (x) Holder’s and/or any Accompanying Parties’ participation in, attendance at, and/or observation of the Event and/or (y) the sole, joint, or comparative negligence, or strict liability, of any of the Released Parties (collectively, the “Spectator Claims”). “Released Parties” are: (i) the WBCI Entities, (ii) each of the WBCI Entities’ respective past, present and future licensees, sponsors, and vendors, and all of their successors and assigns, (iii) all other World Baseball Classic related entities, (iv) the Host Venue and the owners and/or operators thereof, (v) any governmental body associated with the Host Venue, (vi) the ticket vendor and/or provider, and (vii) all past, present and future affiliates, successors, assigns, players, managers, coaches, employees, partners, members, directors, officers, owners, agents, representatives and independent contractors of such entities.
GENERAL RELEASE OF LIABILITY AND COVENANT NOT TO SUE
ON THEIR OWN BEHALF AND ON BEHALF OF ANY RELATED PARTIES, HOLDER, WAIVES, RELEASES, DISCHARGES, HOLDS HARMLESS, AND COVENANTS NOT TO SUE THE RELEASED PARTIES WITH RESPECT TO ANY CLAIM, LIABILITY OR DEMAND OF WHATEVER KIND OR NATURE, EITHER IN LAW OR IN EQUITY, THAT MAY ARISE IN CONNECTION WITH, OR RELATE IN ANY WAY TO, (A) USE OF THIS TICKET, (B) PRESENCE AT THE HOST VENUE OR (C) PARTICIPATION IN THE EVENT OR ANY RELATED ACTIVITIES ARRANGED, PROMOTED AND/OR SPONSORED BY THE RELEASED PARTIES, INCLUDING, WITHOUT LIMITATION, THOSE CLAIMS THAT ARISE AS A RESULT OF: (I) IN WHOLE OR IN PART, THE SOLE, JOINT, OR COMPARATIVE NEGLIGENCE, OR STRICT LIABILITY, OF THE RELEASED PARTIES, AND/OR (II) THE INHERENT RISKS ASSOCIATED WITH VISITING THE HOST VENUE, INCLUDING, WITHOUT LIMITATION (a) ALL SPECTATOR CLAIMS; (b) ALL CLAIMS FOR PERSONAL INJURIES, WRONGFUL DEATH OR EXPOSURE TO OR CONTRACTION OF COVID-19 OR OTHER COMMUNICABLE DISEASE BY HOLDER, ANY ACCOMPANYING PARTIES, OR OTHER INDIVIDUALS EXPOSED TO COVID-19 OR OTHER COMMUNICABLE DISEASE BY HOLDER OR ANY ACCOMPANYING PARTIES; (c) ALL CLAIMS IN CONNECTION WITH ANY SECURITY SEARCHES OR SCREENINGS OF, OR THE APPLICATION OF ANY HEALTH AND SAFETY RULES TO, HOLDER AND/OR ANY ACCOMPANYING PARTIES; AND/OR (d) ALL CLAIMS FOR INVASION OF PRIVACY, DEFAMATION, VIOLATION OF ANY RIGHT OF PUBLICITY, RIGHT OF PRIVACY OR ANY OTHER CAUSE OF ACTION ARISING OUT OF THE PRODUCTION, REPRODUCTION, DISTRIBUTION, TRANSMISSION, PUBLICATION, PUBLIC PERFORMANCE, BROADCAST OR EXHIBITION OF ADVERTISEMENTS, PROMOTIONS, CONTENT, PROGRAMS AND/OR MATERIALS IN WHICH RECORDINGS OR PHOTOGRAPHS OF HOLDER OR ANY ACCOMPANYING PARTIES FROM THE EVENT APPEAR (COLLECTIVELY, THE “RELEASED CLAIMS”).
The acknowledgements and express assumptions of risk, waivers of claims, and releases of liability contained herein are intended to be binding and full waivers of claims and releases of liability, and interpreted to be as broad and inclusive as is permitted by law, including with respect to any controversy, claim or dispute that may arise related to exposure or contraction of COVID-19 or other Communicable Disease. If any part hereof is held to be invalid or legally unenforceable for any reason (the “Affected Provision”), the remainder of the Agreement shall not be affected thereby and shall remain valid and fully enforceable and the Affected Provision shall be enforced to the maximum extent permitted by law.
BY ATTENDING AND/OR PARTICIPATING IN THE EVENT, HOLDER, ON THEIR OWN BEHALF AND ON BEHALF OF ANY RELATED PARTIES, IS DEEMED TO HAVE GIVEN A FULL RELEASE OF LIABILITY TO THE RELEASED PARTIES TO THE FULLEST EXTENT PERMITTED BY LAW.
IF MINOR(S) AND/OR OTHER ACCOMPANYING PARTIES ATTEND THE EVENT WITH HOLDER, HOLDER IS DEEMED TO HAVE GIVEN ALL OF THE FOREGOING GRANTS OF RIGHTS, RELEASES AND WAIVERS ON BEHALF OF: (A) SUCH MINOR(S) AS THEIR PARENT OR GUARDIAN OR AS THE AUTHORIZED AGENT OF THEIR PARENT OR GUARDIAN; AND/OR (B) SUCH OTHER ACCOMPANYING PARTIES, AS THEIR AUTHORIZED AGENT. IF HOLDER DOES NOT WISH TO OR IS NOT AUTHORIZED TO GRANT SUCH RIGHTS, RELEASES AND WAIVERS ON BEHALF OF: (I) SUCH MINOR(S), HOLDER SHOULD IMMEDIATELY LEAVE THE HOST VENUE WITH THOSE MINOR(S); AND/OR (II) ANY OTHER ACCOMPANYING PARTY, SUCH ACCOMPANYING PARTY SHOULD IMMEDIATELY LEAVE THE HOST VENUE.
Holder will indemnify, defend and hold harmless the Released Parties from and against any and all demands, suits, claims, costs (including reasonable attorneys’ fees and expenses), expenses and liability arising out of, incidental to or related in any way to (i) Released Claims, (ii) Holder’s and/or any Accompanying Parties’ acts or omissions, or (iii) Holder’s breach of any of the terms, conditions or representations made in the Agreement.
HOLDER AGREES THAT THE INDEMNITY OBLIGATIONS AND LIABILITIES ASSUMED HEREIN ARE WITHOUT LIMIT AND WITHOUT REGARD TO THE CAUSE OR CAUSES THEREOF, INCLUDING THE SOLE, JOINT, OR CONCURRENT NEGLIGENCE OF ANY RELEASED PARTY, WHETHER ACTIVE OR PASSIVE, STRICT LIABILITY, LATENT, PATENT, OR PRE-EXISTING DEFECTS OR CONDITIONS, AND INCLUDING ANY CLAIMS ARISING OUT OF INGRESS, EGRESS, LOADING AND UNLOADING OF PERSONNEL OR CARGO.
ENTERING THE PLAYING FIELD FOR A GAME, OTHERWISE DISRUPTING AN EVENT AND/OR ATTEMPTING ANY PHYSICAL CONTACT WITH AN EVENT PARTICIPANT IS A CRIME PUNISHABLE BY FINE AND/OR IMPRISONMENT. VIOLATORS MAY BE PROSECUTED TO THE FULLEST EXTENT OF THE LAW.
MANDATORY ARBITRATION AGREEMENT & CLASS ACTION WAIVER (“ARBITRATION AGREEMENT”)
The WBCI Entities care deeply about maintaining good relationships with fans. If you or any of your Accompanying Parties have a problem with this ticket or the Event, a telephone call to customer service may resolve the matter quickly and amicably. Any dispute not resolved informally must be resolved in accordance with this Arbitration Agreement.
Unless prohibited by applicable law, Holder and the WBCI Entities agree to arbitrate any and all claims and disputes relating in any way to Holder’s purchase or Holder’s or any Accompanying Parties’ use of this ticket, Holder’s and/or any Accompanying Parties’ participation in, attendance at, and/or observation of the Event, the Agreement, and any related dealings between them, including, without limitation, claims of illness (including COVID 19 or other Communicable Disease), bodily injury or property damage arising out of Holder’s and/or any Accompanying Parties’ attendance at and/or participation in the Event (“Arbitration Claims”), except for Arbitration Claims concerning the validity, scope or enforceability of this Arbitration Agreement, through BINDING INDIVIDUAL ARBITRATION.
In any Arbitration Claim to be resolved by arbitration, neither Holder nor the WBCI Entities will be able to have a court or jury trial or participate in a class action or class arbitration. Other rights that Holder and the WBCI Entities would have in court will not be available or will be more limited in arbitration, including the right to appeal. Holder and the WBCI Entities each understand and agree that by requiring each other to resolve all disputes through individual arbitration, WE ARE EACH WAIVING THE RIGHT TO A COURT OR JURY TRIAL. ALL DISPUTES SHALL BE ARBITRATED ON AN INDIVIDUAL BASIS, AND NOT AS A CLASS ACTION, REPRESENTATIVE ACTION, CLASS ARBITRATION OR ANY SIMILAR PROCEEDING. The arbitrator(s) may not consolidate the claims of multiple parties.
Arbitrations shall be administered by a well-recognized arbitration body selected by WBCI. The arbitration shall take place in the city where the Host Venue is located. The arbitration shall be presided over by a single arbitrator, who shall be selected in accordance with the rules that, as specified above, shall govern the arbitration. The arbitrator shall be authorized to award any relief that would have been available in court, provided that the arbitrator’s authority is limited to Holder and the WBCI Entities alone, except as otherwise specifically stated herein. No arbitration decision will have any preclusive effect as to non-parties. The arbitrator’s decision shall be final and binding. The parties agree that this Arbitration Agreement extends to any other parties involved in any Arbitration Claims, including, but not limited to, any Accompanying Parties, Related Parties and/or Released Parties. This Arbitration Agreement shall take precedence over the rules of the arbitration organization or arbitrator in the event of any conflict.
Notwithstanding any other provision herein, Holder and the WBCI Entities each may exercise any lawful rights to seek provisional remedies, without waiving the right to arbitrate by doing so. Notwithstanding any other provision of the Agreement, if the foregoing class action waiver and prohibition against class arbitration is determined to be invalid or unenforceable, then this entire Arbitration Agreement shall be void. If any portion of this Arbitration Agreement other than the class action waiver and prohibition against class arbitration is deemed invalid or unenforceable, it shall not invalidate the remaining portions of this Arbitration Agreement. This Arbitration Agreement will survive the termination of the Agreement, the conclusion of the Event, and/or the bankruptcy or insolvency of a party (to the extent permitted by applicable law).
YOU HAVE THE RIGHT TO REJECT THIS ARBITRATION AGREEMENT, BUT YOU MUST EXERCISE THIS RIGHT PROMPTLY. If you do not wish to be bound by this agreement to arbitrate, you must notify us by mailing a written opt-out notice, postmarked within thirty (30) days after the date of the Event. You must send your request to: World Baseball Classic, Inc., Attn: Legal Department, Re: Ticket Arbitration, 1271 Avenue of the Americas, New York, NY 10020. The request must include your full name, address and the statement “I reject the Arbitration Agreement contained in my Event Ticket.” If you exercise the right to reject arbitration, the other terms of the Agreement shall remain in full force and effect as if you had not rejected arbitration.
Prior to bringing a claim under this Arbitration Agreement, the Claimant shall give the other party or parties written notice of the Arbitration Claim (a “Claim Notice”) and a reasonable opportunity, not less than thirty (30) days, to resolve the Arbitration Claim. Any Claim Notice to one or more of the WBCI Entities shall be sent by mail to World Baseball Classic, Inc., Attn: Legal Department, Re: Ticket Claim Notice, 1271 Avenue of the Americas, New York, NY 10020. Any Claim Notice must (a) identify the Claimant by name, address, email address, and telephone number; (b) explain the nature of the Arbitration Claim and the relief demanded; and (c) be submitted only on behalf of the Claimant, and not on behalf of any other party. The Claimant must reasonably cooperate in providing any information about the Arbitration Claim that the other party reasonably requests and must give the other party a reasonable opportunity to respond to the demand for relief.
IF MINOR(S) AND/OR OTHER ACCOMPANYING PARTIES ATTEND THE EVENT WITH HOLDER, HOLDER IS DEEMED TO HAVE AGREED TO THIS ARBITRATION AGREEMENT ON BEHALF OF: (A) SUCH MINOR(S) AS THEIR PARENT OR GUARDIAN OR AS THE AUTHORIZED AGENT OF THEIR PARENT OR GUARDIAN; AND/OR (B) OTHER ACCOMPANYING PARTIES, AS THEIR AUTHORIZED AGENT. IF HOLDER DOES NOT WISH TO OR IS NOT AUTHORIZED TO MAKE SUCH AGREEMENT ON BEHALF OF: (I) ANY ACCOMPANYING MINOR(S), HOLDER SHOULD IMMEDIATELY LEAVE THE HOST VENUE WITH THOSE MINOR(S); AND/OR (II) ANY OTHER ACCOMPANYING PARTY, SUCH ACCOMPANYING PARTY SHOULD IMMEDIATELY LEAVE THE HOST VENUE.
NOTICE
ALL EVENT TIMES ARE SUBJECT TO CHANGE. THE WBCI ENTITIES ARE NOT RESPONSIBLE FOR LOST, STOLEN OR DUPLICATED TICKETS.
Retain possession of this ticket until the Event has been completed. This ticket cannot be replaced if lost, stolen or destroyed. This ticket is good only for this particular Event and no part of the purchase price will be refunded by reason of the failure of the ticket holder to use it for this Event. Should this Event not be played or completed, and WBCI opts, in its sole discretion, to reschedule or resume the Event (or a portion thereof) at the Host Venue (the “Rescheduled Event”), this ticket will admit the ticket holder to the Rescheduled Event, on the date and time that the Rescheduled Event is scheduled to occur, as announced in the sole discretion of WBCI and posted at /world-baseball-classic. No part of the purchase price will be refunded by reason of the failure of Holder to use this ticket for the Rescheduled Event.
Should the Event (or any portion thereof) (a) be canceled and not rescheduled at the Host Venue, (b) not progress to or beyond a point of play constituting a regulation game under Official Baseball Rule 7.01 (a “Regulation Game”) and not be resumed at the Host Venue, or (c) be played without fans, or with limited fans, in attendance, the WBCI Entities will determine in their sole discretion whether any refunds will be issued and post such decision at /world-baseball-classic.
Should the Event progress to or beyond a point of play constituting a Regulation Game, no refunds will be issued.

By using this ticket, ticket holder, on their own behalf and on behalf of any accompanying minor (together, “Holder”), agrees to the following terms and conditions (the “Agreement”), including an AGREEMENT TO ARBITRATE And A class action waiver. World Baseball Classic, Inc. (“WBCI”) may change the terms of the Agreement at any time, without notice (“Agreement Updates”), and Holder’s use of this ticket after Agreement Updates are posted at /world-baseball-classic/tickets/terms will mean that Holder accepts such Agreement Updates. Holder is solely responsible for reading and understanding the Agreement before using this ticket. For the sake of clarity, with regard to each term of this Agreement in which Holder agrees to take or refrain from an action or grants rights, such term shall and does bind the ticket holder and any accompanying minor to, and ticket holder shall cause such accompanying minor to, take or refrain from such action and to grant such rights, such that the ticket holder is agreeing, on behalf of ticket holder and any accompanying minor, that ticket holder and such minor will take or refrain from such action or grant such rights (as applicable).
AN INHERENT RISK OF EXPOSURE TO COVID-19 AND OTHER COMMUNICABLE DISEASES EXISTS IN ANY PUBLIC PLACE REGARDLESS OF PRECAUTIONS THAT MAY BE TAKEN. HOLDER, ON THEIR BEHALF AND ON BEHALF OF ANY ACCOMPANYING PARTIES (AS DEFINED BELOW), AGREES TO (A) ASSUME ALL RISKS ASSOCIATED WITH COVID-19 AND OTHER COMMUNICABLE DISEASES, AND (B) COMPLY WITH ALL RELATED HEALTH & SAFETY POLICIES OF WBCI.
Holder agrees that: a) Holder will not transmit or aid in transmitting any photographs, images, videos, audio, livestreams or other accounts or descriptions (including play-by-play data) (whether text, data or visual), in any media, of all or any part of the game to which this ticket grants admission or any entertainment, attractions, warm-ups, practices, pre-game, post-game or between-inning activities, promotions or competitions offered in connection with the game (the “Game”) or any other event (collectively with the Game, the “Event”) including, but not limited to, any account, description, picture, video, audio, reproduction or other information concerning the Game or other Event (collectively, the “Game Information”); b) WBCI is the exclusive owner of all copyrights and other proprietary rights in the Game and the Game Information; and c) WBCI, the Office of the Commissioner of Baseball, MLB Advanced Media, L.P., The MLB Network, LLC, the Clubs of Major League Baseball, Major League Baseball Properties, Inc., the national baseball federations participating in the World Baseball Classic, the players and other individuals participating in the World Baseball Classic, Major League Baseball Players Association, MLB Players, Inc. and each of their respective past, present and future subsidiaries, affiliates, agents, officers, employees, members, directors and owners (collectively, the “WBCI Entities”), and certain current and future sponsors and licensees of such WBCI Entities, will have the unrestricted right and license to use Holder’s image, likeness, name, voice, comments and/or other proprietary or public rights in any live or recorded broadcast, telecast, photograph, video, audio, audiovisual and/or other recording taken in connection with the Event or other transmission, distribution, public performance, or reproduction in whole or in part of the Event, for all legitimate purposes including without limitation broadcasting, transmitting and promoting the Event by the WBCI Entities, worldwide, in perpetuity, and in any and all media now or hereafter known, without compensation. The rights granted herein to the WBCI Entities are assignable.
Holder, on their own behalf and on behalf of any Accompanying Parties (as defined at the conclusion of this paragraph), (a) consents to security searches, screenings and/or inspection of Holder’s and/or any Accompanying Parties’ person, bags, clothing, or other articles for security purposes, whether by walk-through metal detection, handheld metal detection, bag checks or otherwise; and (b) acknowledges and agrees to comply with all relevant policies and protocols issued by any WBCI Entity, including, without limitation, any policies and protocols regarding security, bags, fan conduct and/or health and safety (each, a “Policy” and collectively, the “Policies”), all of which, due to the evolving nature of matters related to health, security, safety and the like, may continue to be updated from time to time between purchase of this ticket and the Event date, and (ii) all applicable laws, orders and policies of national and local authorities (subsections (i) and (ii) are, collectively, “Health and Safety Rules”). Holder acknowledges that to the extent permitted by law, the WBCI Entities have no liability for Holder’s and/or any Accompanying Parties’ person or property. An “Accompanying Party” is any accompanying party (other than accompanying minors) for whom Holder retains a ticket to attend the Event with Holder (each of whom Holder represents have authorized Holder to act on their behalf in accepting the applicable Agreement terms) (collectively, the “Accompanying Parties”).
The WBCI Entities reserve the right, without refund of any portion of such purchase price, to revoke any or all license(s) granted by this ticket and refuse admission to, or eject from, the Event, Holder and any Accompanying Parties if any such person: a) violates the terms of the Agreement, including without limitation any Policy; b) is in possession of any item or object that the WBCI Entities consider potentially dangerous, hazardous, inappropriate and/or injurious to other patrons (collectively, “Prohibited Items), and any such Prohibited Items may be confiscated; c) appears to be or is intoxicated; d) engages in conduct deemed by any of the WBCI Entities to be improper, disorderly or unbecoming; e) uses vulgar or abusive language; or f) poses a risk to the health or safety of others.
Holder assumes all risk associated with the purchase of this ticket from anyone other than WBCI or its designated agents. This ticket may not be used for advertising, promotion (including contests and sweepstakes), or other trade or commercial purposes without the express written consent of WBCI. No offer to resell or resale of this ticket is permitted to the extent prohibited by any applicable law or regulation or in violation of any Policy. Any such resale will invalidate the license granted by this ticket. This ticket may not be resold or offered for resale inside the host venue, including the ballpark, surrounding grounds and parking areas (collectively, the “Host Venue”), and any person who sells or offers this ticket for resale at any price inside the Host Venue will be removed from the premises and may receive a fine.
Holder, on their behalf and on behalf of any Accompanying Parties, agrees to comply with all terms and conditions presented at the time of purchase of this ticket not specifically enumerated herein, including without limitation a) terms that mandate or prescribe the quantity of tickets available to be purchased, b) additional requirements regarding Accompanying Parties, and c) terms regarding the resale or transfer of tickets.
FAN HEALTH PROMISE
Holder acknowledges and understands that, if infected with COVID-19 or other Communicable Disease (as defined at the conclusion of this paragraph), Holder and/or any Accompanying Parties may infect others that they may subsequently come in contact with, even if they are not experiencing or displaying any symptoms of illness, and that the risk of exposure to others remains at all times. Accordingly, Holder agrees that neither Holder nor any Accompanying Party will attend the Event if, on the date of the Event, they are required or recommended by Health and Safety Rules to stay at home, quarantine and/or isolate (e.g., as a result of testing positive for, experiencing symptoms of, or being in direct contact with someone who tested positive for, COVID-19 or other Communicable Disease).
A “Communicable Disease” as used herein is COVID-19, any strains, variants, or mutations thereof, the coronavirus that causes COVID-19, and/or any other airborne, aerosolized or surface transmissible communicable and/or infectious diseases, viruses, bacteria or illnesses or the causes thereof.
ASSUMPTION OF RISK RELATED TO COVID-19 AND OTHER COMMUNICABLE DISEASES
Holder, on their behalf and on behalf of any Accompanying Parties, acknowledges, and expressly and voluntarily assumes all risks that are in any way related to or arising from being exposed to or contracting COVID-19 or other Communicable Disease in the Host Venue. By using this ticket, Holder is acknowledging and confirming, on behalf of Holder and any Related Parties (as defined at the conclusion of this paragraph) both now and in the future, that Holder understands and expressly assumes the risk that Holder and/or any Accompanying Parties may be exposed to COVID-19 or other Communicable Disease. Holder expressly understands that these risks include contracting COVID-19 or other Communicable Disease and the associated dangers, medical complications and physical and mental injuries, both foreseen and unforeseen, that may result from contracting COVID-19 or other Communicable Disease. Holder further acknowledges and understands, on their own behalf and on behalf of any Accompanying Parties: that any interaction with the general public poses an inherent risk of being exposed to and contracting Communicable Disease, including, but not limited to, COVID-19; that it cannot be guaranteed that Holder and/or any Accompanying Parties will not be exposed; and that as such, potential exposure to or contraction of COVID-19 or other Communicable Disease are risks inherent in Holder’s decision to use this ticket and cannot be eliminated. “Related Parties” are any Accompanying Parties as well as Holder’s and any Accompanying Parties’ personal representatives, assigns, heirs, next of kin and any other person or entity that may be entitled to make a claim on their behalf.
ASSUMPTION OF RISK OF PERSONAL INJURY, ILLNESS AND/OR PROPERTY DAMAGE
Holder recognizes that attendance of Holder and any Accompanying Parties at the Event is voluntary and may result in personal injury (including death), illness and/or property damage. Holder agrees to abide by all Policies and to stay alert and remain aware of Holder’s surroundings and the surroundings of any Accompanying Parties. By using this ticket or by attending, observing or participating in the Event, Holder, on their own behalf and on behalf of any Related Parties, acknowledges and assumes all risks and dangers associated with: (a) being a spectator before, during, and after a baseball game (including all warm-ups, practices, pre-game, post-game and between-inning activities, promotions and competitions), and (b) attending, observing or participating in the Event, in each case, whether any such risk or danger occurs prior to, during or subsequent thereto, including specifically (but not exclusively) the danger of being injured by thrown bats; bat fragments; thrown or batted balls; thrown, dropped, or launched items; projectiles; persons; animals; other hazards or distractions; and any incidents or accidents associated with crowds of people or the negligence or misconduct of other spectators. Holder, on their behalf and on behalf of any Related Parties, agrees that the Released Parties (as defined at the conclusion of this paragraph) will not be responsible for any personal injury (including death), illness, property damage, or other loss suffered as a result of (x) Holder’s and/or any Accompanying Parties’ participation in, attendance at, and/or observation of the Event and/or (y) the sole, joint, or comparative negligence, or strict liability, of any of the Released Parties (collectively, the “Spectator Claims”). “Released Parties” are: (i) the WBCI Entities, (ii) each of the WBCI Entities’ respective past, present and future licensees, sponsors, and vendors, and all of their successors and assigns, (iii) all other World Baseball Classic related entities, (iv) the Host Venue and the owners and/or operators thereof, (v) any governmental body associated with the Host Venue, (vi) the ticket vendor and/or provider, and (vii) all past, present and future affiliates, successors, assigns, players, managers, coaches, employees, partners, members, directors, officers, owners, agents, representatives and independent contractors of such entities.
GENERAL RELEASE OF LIABILITY AND COVENANT NOT TO SUE
ON THEIR OWN BEHALF AND ON BEHALF OF ANY RELATED PARTIES, HOLDER, WAIVES, RELEASES, DISCHARGES, HOLDS HARMLESS, AND COVENANTS NOT TO SUE THE RELEASED PARTIES WITH RESPECT TO ANY CLAIM, LIABILITY OR DEMAND OF WHATEVER KIND OR NATURE, EITHER IN LAW OR IN EQUITY, THAT MAY ARISE IN CONNECTION WITH, OR RELATE IN ANY WAY TO, A) USE OF THIS TICKET, B) PRESENCE AT THE HOST VENUE OR C) PARTICIPATION IN THE EVENT OR ANY RELATED ACTIVITIES ARRANGED, PROMOTED AND/OR SPONSORED BY THE RELEASED PARTIES, INCLUDING, WITHOUT LIMITATION, THOSE CLAIMS THAT ARISE AS A RESULT OF: (I) IN WHOLE OR IN PART, THE SOLE, JOINT, OR COMPARATIVE NEGLIGENCE, OR STRICT LIABILITY, OF THE RELEASED PARTIES, AND/OR (II) THE INHERENT RISKS ASSOCIATED WITH VISITING THE HOST VENUE, INCLUDING, WITHOUT LIMITATION a) ALL SPECTATOR CLAIMS; b) ALL CLAIMS FOR PERSONAL INJURIES, WRONGFUL DEATH OR EXPOSURE TO OR CONTRACTION OF COVID-19 OR OTHER COMMUNICABLE DISEASE BY HOLDER, ANY ACCOMPANYING PARTIES, OR OTHER INDIVIDUALS EXPOSED TO COVID-19 OR OTHER COMMUNICABLE DISEASE BY HOLDER OR ANY ACCOMPANYING PARTIES; c) ALL CLAIMS IN CONNECTION WITH ANY SECURITY SEARCHES OR SCREENINGS OF, OR THE APPLICATION OF ANY HEALTH AND SAFETY RULES TO, HOLDER AND/OR ANY ACCOMPANYING PARTIES; AND/OR d) ALL CLAIMS FOR INVASION OF PRIVACY, DEFAMATION, VIOLATION OF ANY RIGHT OF PUBLICITY, RIGHT OF PRIVACY OR ANY OTHER CAUSE OF ACTION ARISING OUT OF THE PRODUCTION, REPRODUCTION, DISTRIBUTION, TRANSMISSION, PUBLICATION, PUBLIC PERFORMANCE, BROADCAST OR EXHIBITION OF ADVERTISEMENTS, PROMOTIONS, CONTENT, PROGRAMS AND/OR MATERIALS IN WHICH RECORDINGS OR PHOTOGRAPHS OF HOLDER OR ANY ACCOMPANYING PARTIES FROM THE EVENT APPEAR (COLLECTIVELY, THE “RELEASED CLAIMS”).
The acknowledgements and express assumptions of risk, waivers of claims, and releases of liability contained herein are intended to be binding and full waivers of claims and releases of liability, and interpreted to be as broad and inclusive as is permitted by law, including with respect to any controversy, claim or dispute that may arise related to exposure or contraction of COVID-19 or other Communicable Disease. If any part hereof is held to be invalid or legally unenforceable for any reason (the “Affected Provision”), the remainder of the Agreement shall not be affected thereby and shall remain valid and fully enforceable and the Affected Provision shall be enforced to the maximum extent permitted by law.
BY ATTENDING AND/OR PARTICIPATING IN THE EVENT, HOLDER, ON THEIR OWN BEHALF AND ON BEHALF OF ANY RELATED PARTIES, IS DEEMED TO HAVE GIVEN A FULL RELEASE OF LIABILITY TO THE RELEASED PARTIES TO THE FULLEST EXTENT PERMITTED BY LAW.
IF MINOR(S) AND/OR OTHER ACCOMPANYING PARTIES ATTEND THE EVENT WITH HOLDER, HOLDER IS DEEMED TO HAVE GIVEN ALL OF THE FOREGOING GRANTS OF RIGHTS, RELEASES AND WAIVERS ON BEHALF OF: (A) SUCH MINOR(S) AS THEIR PARENT OR GUARDIAN OR AS THE AUTHORIZED AGENT OF THEIR PARENT OR GUARDIAN; AND/OR (B) SUCH OTHER ACCOMPANYING PARTIES, AS THEIR AUTHORIZED AGENT. IF HOLDER DOES NOT WISH TO OR IS NOT AUTHORIZED TO GRANT SUCH RIGHTS, RELEASES AND WAIVERS ON BEHALF OF: (I) SUCH MINOR(S), HOLDER SHOULD IMMEDIATELY LEAVE THE HOST VENUE WITH THOSE MINOR(S); AND/OR (II) ANY OTHER ACCOMPANYING PARTY, SUCH ACCOMPANYING PARTY SHOULD IMMEDIATELY LEAVE THE HOST VENUE.
Holder will indemnify, defend and hold harmless the Released Parties from and against any and all demands, suits, claims, costs (including reasonable attorneys’ fees and expenses), expenses and liability arising out of, incidental to or related in any way to (i) Released Claims, (ii) Holder’s and/or any Accompanying Parties’ acts or omissions, or (iii) Holder’s breach of any of the terms, conditions or representations made in the Agreement.
HOLDER AGREES THAT THE INDEMNITY OBLIGATIONS AND LIABILITIES ASSUMED HEREIN ARE WITHOUT LIMIT AND WITHOUT REGARD TO THE CAUSE OR CAUSES THEREOF, INCLUDING THE SOLE, JOINT, OR CONCURRENT NEGLIGENCE OF ANY RELEASED PARTY, WHETHER ACTIVE OR PASSIVE, STRICT LIABILITY, LATENT, PATENT, OR PRE-EXISTING DEFECTS OR CONDITIONS, AND INCLUDING ANY CLAIMS ARISING OUT OF INGRESS, EGRESS, LOADING AND UNLOADING OF PERSONNEL OR CARGO.
ENTERING THE PLAYING FIELD FOR A GAME, OTHERWISE DISRUPTING AN EVENT AND/OR ATTEMPTING ANY PHYSICAL CONTACT WITH AN EVENT PARTICIPANT MAY BE PUNISHABLE BY FINE AND/OR IMPRISONMENT. VIOLATORS MAY BE PROSECUTED TO THE FULLEST EXTENT OF THE LAW.
MANDATORY ARBITRATION AGREEMENT & CLASS ACTION WAIVER (“ARBITRATION AGREEMENT”)
The WBCI Entities care deeply about maintaining good relationships with fans. If you or any of your Accompanying Parties have a problem with this ticket or the Event, a telephone call to customer service may resolve the matter quickly and amicably. Any dispute not resolved informally must be resolved in accordance with this Arbitration Agreement.
Unless prohibited by applicable law, Holder and the WBCI Entities agree to arbitrate any and all claims and disputes relating in any way to Holder’s purchase or Holder’s or any Accompanying Parties’ use of this ticket, Holder’s and/or any Accompanying Parties’ participation in, attendance at, and/or observation of the Event, the Agreement, and any related dealings between them, including, without limitation, claims of illness (including COVID 19 or other Communicable Disease), bodily injury or property damage arising out of Holder’s and/or any Accompanying Parties’ attendance at and/or participation in the Event (“Arbitration Claims”), except for Arbitration Claims concerning the validity, scope or enforceability of this Arbitration Agreement, through BINDING INDIVIDUAL ARBITRATION.

Holder and the WBCI Entities each understand and agree that by requiring each other to resolve all disputes through individual arbitration, WE ARE EACH WAIVING THE RIGHT TO A COURT OR JURY TRIAL. ALL DISPUTES SHALL BE ARBITRATED ON AN INDIVIDUAL BASIS, AND NOT AS A CLASS ACTION, REPRESENTATIVE ACTION, CLASS ARBITRATION OR ANY SIMILAR PROCEEDING. The arbitrator(s) may not consolidate the claims of multiple parties.
Arbitrations shall be administered by a well-recognized arbitration body selected by WBCI. The arbitration shall take place in the city where the Host Venue is located. The arbitration shall be presided over by a single arbitrator, who shall be selected in accordance with the rules that, as specified above, shall govern the arbitration. The arbitrator shall be authorized to award any relief that would have been available in court, provided that the arbitrator’s authority is limited to Holder and the WBCI Entities alone, except as otherwise specifically stated herein. No arbitration decision will have any preclusive effect as to non-parties. The arbitrator’s decision shall be final and binding. The parties agree that this Arbitration Agreement extends to any other parties involved in any Arbitration Claims, including, but not limited to, any Accompanying Parties, Related Parties and/or Released Parties. This Arbitration Agreement shall take precedence over the rules of the arbitration organization or arbitrator in the event of any conflict.
Notwithstanding any other provision herein, Holder and the WBCI Entities each may exercise any lawful rights to seek provisional remedies, without waiving the right to arbitrate by doing so. Notwithstanding any other provision of the Agreement, if the foregoing class action waiver and prohibition against class arbitration is determined to be invalid or unenforceable, then this entire Arbitration Agreement shall be void. If any portion of this Arbitration Agreement other than the class action waiver and prohibition against class arbitration is deemed invalid or unenforceable, it shall not invalidate the remaining portions of this Arbitration Agreement. This Arbitration Agreement will survive the termination of the Agreement, the conclusion of the Event, and/or the bankruptcy or insolvency of a party (to the extent permitted by applicable law).
YOU HAVE THE RIGHT TO REJECT THIS ARBITRATION AGREEMENT, BUT YOU MUST EXERCISE THIS RIGHT PROMPTLY. If you do not wish to be bound by this agreement to arbitrate, you must notify us by mailing a written opt-out notice, postmarked within thirty (30) days after the date of the Event. You must send your request to: World Baseball Classic, Inc., Attn: Legal Department, Re: Ticket Arbitration, 1271 Avenue of the Americas, New York, NY 10020. The request must include your full name, address and the statement “I reject the Arbitration Agreement contained in my Event Ticket.” If you exercise the right to reject arbitration, the other terms of the Agreement shall remain in full force and effect as if you had not rejected arbitration.
Prior to bringing a claim under this Arbitration Agreement, the Claimant shall give the other party or parties written notice of the Arbitration Claim (a “Claim Notice”) and a reasonable opportunity, not less than thirty (30) days, to resolve the Arbitration Claim. Any Claim Notice to one or more of the WBCI Entities shall be sent by mail to World Baseball Classic, Inc., Attn: Legal Department, Re: Ticket Claim Notice, 1271 Avenue of the Americas, New York, NY 10020. Any Claim Notice must a) identify the Claimant by name, address, email address, and telephone number; b) explain the nature of the Arbitration Claim and the relief demanded; and c) be submitted only on behalf of the Claimant, and not on behalf of any other party. The Claimant must reasonably cooperate in providing any information about the Arbitration Claim that the other party reasonably requests and must give the other party a reasonable opportunity to respond to the demand for relief.
IF MINOR(S) AND/OR OTHER ACCOMPANYING PARTIES ATTEND THE EVENT WITH HOLDER, HOLDER IS DEEMED TO HAVE AGREED TO THIS ARBITRATION AGREEMENT ON BEHALF OF: (A) SUCH MINOR(S) AS THEIR PARENT OR GUARDIAN OR AS THE AUTHORIZED AGENT OF THEIR PARENT OR GUARDIAN; AND/OR (B) OTHER ACCOMPANYING PARTIES, AS THEIR AUTHORIZED AGENT. IF HOLDER DOES NOT WISH TO OR IS NOT AUTHORIZED TO MAKE SUCH AGREEMENT ON BEHALF OF: (I) ANY ACCOMPANYING MINOR(S), HOLDER SHOULD IMMEDIATELY LEAVE THE HOST VENUE WITH THOSE MINOR(S); AND/OR (II) ANY OTHER ACCOMPANYING PARTY, SUCH ACCOMPANYING PARTY SHOULD IMMEDIATELY LEAVE THE HOST VENUE.
NOTICE
ALL EVENT TIMES ARE SUBJECT TO CHANGE. THE WBCI ENTITIES ARE NOT RESPONSIBLE FOR LOST, STOLEN OR DUPLICATED TICKETS.
Retain possession of this ticket until the Event has been completed. This ticket cannot be replaced if lost, stolen or destroyed. This ticket is good only for this particular Event and no part of the purchase price will be refunded by reason of the failure of the ticket holder to use it for this Event. Should this Event not be played or completed, and WBCI opts, in its sole discretion, to reschedule or resume the Event (or a portion thereof) at the Host Venue (the “Rescheduled Event”), this ticket will admit the ticket holder to the Rescheduled Event, on the date and time that the Rescheduled Event is scheduled to occur, as announced in the sole discretion of WBCI and posted at /world-baseball-classic. No part of the purchase price will be refunded by reason of the failure of Holder to use this ticket for the Rescheduled Event.
Should the Event (or any portion thereof) (a) be canceled and not rescheduled at the Host Venue, (b) not progress to or beyond a point of play constituting a regulation game under Official Baseball Rule 7.01 (a “Regulation Game”) and not be resumed at the Host Venue, or (c) be played without fans, or with limited fans, in attendance, the WBCI Entities will determine in their sole discretion whether any refunds will be issued and post such decision at /world-baseball-classic.
Should the Event progress to or beyond a point of play constituting a Regulation Game, no refunds will be issued.

持票人使用本票券即表示持票人（代表自己及同行之任何未成年人，合稱「持票人」）同意接受下列條款及條件（下稱「本合約」），包括同意仲裁及不提起團體訴訟之條款。World Baseball Classic, Inc.（下稱「WBCI」）得隨時變更本合約條款（下稱「更新版合約」），不待另行通知。在WBCI於/world-baseball-classic/tickets/terms公告更新版合約後，持票人使用本票券即代表持票人同意接受更新版合約。持票人應自行負責於使用本票券前詳閱及瞭解本合約。為免疑義，本合約中關於持票人同意採取或不採取特定行動或授予特定權利之各項條款，均應且確實對持票人及同行之未成年人有拘束力，持票人應促使同行之未成年人採取或不採取該等行動並授予該等權利；為此，持票人代表自己及同行之任何未成年人，同意持票人及該等未成年人將採取或不採取該等行動或將授予該等權利（依情況適用）。
無論採取何種預防措施，任何公共場所均存在接觸新冠肺炎以及其他傳染性疾病的固有風險。持票人，代表自己及任何陪同人（定義詳下），同意：(a) 承擔所有與新冠肺炎及其他傳染病相關之風險；及 (b) 遵守一切相關之WBCI健康及安全政策。
持票人同意：(a) 持票人絕不在任何媒體上，傳輸或協助傳輸本票券授予入場資格的比賽（下稱「本球賽」）或為本球賽舉辦的任何相關娛樂活動、花絮、熱身、練習、賽前活動、賽後活動或局間活動、宣傳活動、競賽或任何其他活動（與本球賽合稱「本活動」）之全部或一部的任何照片、影像、影片、音訊、現場直播或其他敘述或描述（包括實況數據）（無論以文字、數據或是視覺形式呈現），包括但不限於任何關於本球賽或其他活動（合稱「球賽資訊」）之敘述、描述、照片/圖片、影片、音訊、重製或其他資訊；(b) WBCI為本球賽及球賽資訊之所有著作權及其他專有權之獨家所有人；以及 (c) WBCI、美國職業棒球大聯盟主席辦公室（Office of the Commissioner of Baseball）、MLB Advanced Media, L.P.、The MLB Network, LLC、美國職業棒球大聯盟球隊、Major League Baseball Properties, Inc.、參與世界棒球經典賽（World Baseball Classic）的各國棒球總會、球員及其他個人，美國職業棒球大聯盟球員協會（Major League Baseball Players Association）、MLB Players, Inc.，及其各自之過去、現在及未來子公司、關係企業、代理人、經理人、員工、成員、董事及所有人（合稱「WBCI成員」），以及WBCI成員現在及未來特定贊助商及被授權人，擁有不受限制之權利及授權，可以在全球且永久為一切合法目的（包括但不限於由WBCI成員進行本活動之廣播、播送及推廣），於任何及所有現在已知或未來出現之媒體上，無償於任何為本活動製作之直播或預錄電台節目、電視節目、照片、影片、音訊、影音及/或其他紀錄，或本活動全部或一部之其他播送、發布、公開演出或重製中，使用持票人之形象、肖像、姓名、聲音、評論及/或其他專有或公開權利。本合約下授予WBCI成員之權利可以轉讓。
持票人代表自己及任何陪同人（定義詳本條末）：(a) 同意為安全目的而對持票人及/或任何陪同人之人身、行李、衣物或其他物品進行安全搜查、過濾及/或檢查，包括透過門框型或掌上型金屬探測器、行李檢查或其他方式進行：及 (b) 肯認並同意遵守：(i) 任何WBCI成員發布之所有相關政策及程序，包括但不限於任何關於安全、行李、粉絲行為及/或健康與安全之政策及程序（下稱「WBCI政策」）；因健康、安全、安全等相關事宜之不確定性，在您購買本票券及本活動日期之間，上述政策可能會持續隨時更新；及 (ii) 國家及地方主管機關之所有適用法律、命令及政策（子條款(i)與(ii)合併稱為「健康與安全規則」）；。持票人確認，於法律許可範圍內，WBCI成員對持票人及/或任何陪同人之人身或財產不承擔任何責任。「陪同人」係持票人為其持有一張門票並與持票人一起參加本活動之任何同行者（不包括同行未成年人）（且持票人聲明已獲陪同人授權代表其接受適用之本合約條款）（合稱「陪同人」）。
若持票人及陪同人發生下列情況，WBCI成員有權在不退還任何購票價金之情況下，撤銷本票券授予之任何或一切授權，並拒絕持票人及陪同人參與本活動或要求其離開本活動：(a) 違反本合約條款，包括但不限於任何WBCI政策；(b) 持有WBCI成員認為對其他觀眾有潛在危險、危害、不適當及/或傷害之任何物品或物體（合稱「禁止物品」），且任何禁止物品均得被沒收；(c) 有酒醉跡象或實際酒醉；(d) 從事任何WBCI成員認為不適當、脫序或不得體的行為；(e) 使用粗俗或辱駡性語言；或 (f) 對他人之健康或安全造成風險。
持票人若向WBCI或其指定代理人以外之任何人購買本票券，所有風險由持票人自行承擔。未經WBCI明示書面同意，本票券不得用於廣告、宣傳（包括競賽及抽獎）或其他貿易或商業目的。在法律或法規禁止或違反WBCI政策的情況下，不得兜售或轉售本票券。這種轉售行為將使本票券授予之權利失效。不得在本活動場館（包括球場、周邊區域及停車場，合稱「活動場館」）內兜售或轉售本票券；任何在活動場館內以任何價格兜售或轉售本票券之人，將被要求離開活動場館並可能遭到罰款。
持票人（代表自己及任何陪同人）同意遵守本票券購買當時之所有條款及條件，包括但不限於：(a) 授權或約定可購買門票數量之條款；(b) 關於陪同人的進一步規範；以及 (c) 關於票券轉售或轉讓之條款。
球迷健康承諾
持票人肯認並瞭解，若感染新冠肺炎或其他傳染病（定義詳本條末），持票人及/或任何陪同人可能會感染後續接觸之人，即使未經歷或出現任何疾病症狀亦然，且接觸他人之風險無論何時均存在。因此，持票人同意，持票人或任何陪同人若於在事件發生當日，根據健康與安全規則，若他們被要求或建議待在家中、隔離和/或自我隔離（例如，因為檢測出 COVID-19 或其他傳染病陽性、出現症狀，或與檢測為陽性的人有直接接觸），即不應參加本活動。
本合約稱「傳染病」係指新冠肺炎，其任何菌株、變種或突變，導致新冠肺炎之冠狀病毒，及/或任何其他透過空氣傳播、氣溶膠或表面傳播之傳染病、病毒、細菌或疾病或其原因。
承擔與新冠肺炎及其他傳染病相關之風險
持票人（代表自己及任何陪同人）肯認並明示自願承擔透過任何方式與在活動場館遭暴露或接觸新冠肺炎或其他傳染病相關或因其產生之所有風險。持票人使用本票券即表示持票人代表自己及任何關係人（定義詳本條末）肯認並確認，持票人現在及未來均瞭解並明示同意承擔持票人及/或任何陪同人可能接觸新冠肺炎或其他傳染病之風險。持票人明確瞭解，該等風險包括感染新冠肺炎或其他傳染病，及因感染新冠肺炎或其他傳染病而可能導致之相關危險、醫療併發症及身體及精神傷害，包括可預見及無法預見者皆然。持票人進一步代表自己及任何陪同人聲明其肯認及瞭解，與公眾之任何互動均會帶來接觸及感染傳染病（包括但不限於新冠肺炎）之固有風險，無法保證持票人及/或任何陪同人不被感染。因此，新冠肺炎或其他傳染病之潛在暴露或感染為持票人決定使用本票券之固有且無法排除的風險。「關係人」係指任何陪同人及持票人及任何陪同人之個人代表、受讓人、繼承人、直系親屬及任何其他可能有權代表其提出請求之個人或實體。
承擔人身傷害、疾病及/或財產損失之風險
持票人確認，持票人及任何陪同人均為自願參加本活動，且本活動可能導致人身傷害（包括死亡）、疾病及/或財產損失。持票人同意遵守所有WBCI政策，並對持票人之周圍環境及任何陪同人之周圍環境保持警覺及注意。一旦使用本票券或出席、觀看或參與本活動，即表示持票人（代表自己及任何關係人）肯認並承擔所有與下列相關之風險及危險：(a)於棒球比賽開始之前、期間及之後擔任觀眾（包括所有熱身、練習、賽前、賽後及局間活動、宣傳及比賽）；及 (b) 出席、觀看或參與本活動；於前述各種情況下，無論是在該等風險或危險發生之前、期間或之後，特別包括（但不限於）遭拋出的球棒、球棒碎片、遭拋出或打擊之棒球、被拋出、掉落或發射的物品、投射物、人、動物、其他危險或干擾所傷害的危險，以及與人群或其他觀眾之疏失或不當行為相關之任何事件或事故。持票人（代表自己及任何關係人）同意受豁免方（定義詳本條末）毋須為任何因下列事由造成的人身傷害（包括死亡）、疾病、財產損失或其他損失（合稱「觀眾請求」）負責：(x) 持票人及/或任何陪同人參與、出席及/或觀看本活動；及/或 (y) 任何受豁免方之單獨、共同或比較過失或嚴格責任。「受豁免方」係指：(i) WBCI成員；(ii) WBCI成員各自之過去、現在及未來之被授權人、贊助商及廠商，及其所有繼受者及受讓人；(iii) 所有其他世界棒球經典賽（World Baseball Classic）相關成員；(iv) 活動場館及其所有人及/或營運商；(v) 任何與活動場館相關之政府機關；(vi) 門票廠商及/或供應商；及 (vii) 前述成員之所有過去、現在及未來之關係企業、繼受者、受讓人、球員、經理、教練、員工、合作夥伴、成員、董事、經理人、所有人、代理人、代表及獨立承包商。
責任概括豁免及不提出訴訟之承諾
持票人代表自己及任何關係人，茲此就任何因下列事由造成、與其相關或以任何方式有任何連結之任何類型或性質的請求、責任或要求，拋棄其相關權利，豁免及解除受豁免方之相關責任，並承諾不就此向受豁免方提出訴訟：(a) 本票券之使用；(b) 進入活動場館；或 (c) 參與本活動或任何由豁免方安排、推廣及/或贊助之相關活動，包括但不限於因下列事由造成的請求：(i) 受豁免方單獨、共同或比較過失或嚴格責任（全部或部分）；及/或 (ii) 與進入活動場館相關之固有風險，包括但不限於：(a) 所有觀眾請求；(b) 由持票人、任何陪同人，或其他因持票人或任何陪同人而接觸到新冠肺炎或其他傳染病之個人，就人身傷害、不當致死、接觸或感染新冠肺炎或其他傳染病提出的所有請求；(c) 與對持票人及/或任何陪同人實施任何安全搜索或檢查或任何健康及安全保護規範相關的所有請求；及/或 (d) 所有因製作、重製、發布、傳播、出版、公開表演、廣播或展示其中含有持票人或任何陪同人之本活動錄音/錄影/紀錄或照片的廣告、宣傳、內容、節目及/或素材而引起之侵害隱私權、誹謗、侵害任何公開權、隱私權利或任何其他原因之請求（合稱「受豁免請求」）。
本合約所載之確認事項、明示風險承擔、請求權拋棄及責任豁免，均具有拘束力，且屬完整權利之拋棄及完整責任之豁免，且應於法律許可範圍內以廣義且兼容的方式解釋，包括與新冠肺炎或其他傳染病之接觸或感染相關之任何糾紛、請求或爭議。若本合約之任何部分因任何事由被認定為無效或於法律上無法執行（下稱「受影響條款」），本合約之其餘部分不受影響，應維持有效且可完全執行，受影響條款應於法律允許之最大範圍內執行。
持票人一旦出席及/或參與本活動，持票人（包括自己及任何關係人）即被視為已於法律許可之最大範圍內，完全免除受豁免方之責任。
若未成年人及/或其他陪同人與持票人一起參加本活動，持票人將被視為代表以下人士授予、豁免及拋棄上述所有權利：(a) 代表未成年人（持票人為父母或監護人或其父母或監護人之授權代理人）；及/或 (b) 代表其他陪同人（持票人為其授權代理人）。若持票人不願意或未被授權代表未成年人授予、豁免及拋棄上述所有權利，持票人應立即與未成年人一起離開活動場館；若持票人不願意或未被授權代表其他陪同人授予、豁免及拋棄上述所有權利，該等陪同人應立即離開活動場館。
若受豁免方因下列事由而產生任何要求、訴訟、請求、費用（包括合理之律師費及開支）、開支及責任，持票人應向其提供賠償、為其抗辯，使其不因此受任何損害：(i) 受豁免請求；(ii) 持票人及/或任何陪同人之作為或不作為；或 (iii) 持票人違反本合約任何條款、條件或聲明引起、造成或與其相關之責任。
持票人同意，於本合約下承擔之賠償義務及責任不受任何限制，亦不考量其原因，包括任何受豁免方單獨、共同或混合過失（無論是主動或被動），嚴格責任，隱蔽、明顯或預先存在之瑕疵或情況，包括任何因人員或貨物之進入、退出、裝載及卸載而產生之請求。
進入比賽場地、以其他方式干擾活動，及/或試圖與活動參與者進行任何身體接觸，可能被處以罰款及/或監禁。違反者在法律許可之最大範圍內可能遭到起訴。
強制性仲裁協議及團體訴訟權利之拋棄（下稱「仲裁協議」）
WBCI成員非常重視與粉絲維持良好關係。若您或您的任何陪同人對本票券或本活動有任何問題，撥打客服專線即可迅速順利解決問題。任何無法以非正式方式解決之爭議，均必須依據本仲裁協議解決。
除非相關法律禁止，持票人及WBCI成員同意以具拘束性之個別仲裁解決任何及有與下列事由相關之請求及糾紛：持票人購買或持票人或任何陪同人使用本票券、持票人及/或任何陪同人參與、出席及/或觀看本活動、本合約，及雙方間之任何相關交易，包括但不限於因持票人及/或任何陪同人出席及/或參與本活動而造成的疾病（包括新冠肺炎或其他傳染病）、身體傷害或財產損失之請求（下稱「仲裁請求」），惟不含關於本仲裁協議之有效性、範圍或可執行性之仲裁請求。
在任何透過仲裁解決之仲裁請求中，持票人及WBCI成員均不應選擇法院或陪審團程序，或參與團體訴訟或團體仲裁。在仲裁程序中，持票人及WBCI成員在法院程序中擁有的其他權利（包括上訴權利）將不存在或受到限制。持票人及WBCI成員各自瞭解並同意，透過要求他方採用個別仲裁解決所有爭議，雙方各自拋棄選擇法院或陪審團程序之權利。所有爭議均應以個別案件為基礎進行仲裁，不得採用團體訴訟、代表訴訟、團體仲裁或任何類似程序。仲裁人不得合併多方當事人的請求。
仲裁應由WBCI選擇具良好聲譽之仲裁機構實施。仲裁應於活動場館所在之城市進行。仲裁應由一名仲裁人主持，該仲裁人應依據上述仲裁規則進行選擇。仲裁人有權授予任何可於法院程序取得的救濟，除本合約另有約定外，仲裁人權力範圍僅限於持票人及WBCI成員。任何仲裁決定均不會對非當事人產生任何對其有妨礙性之影響。仲裁人之決定應具終局性且具拘束力。雙方同意，本仲裁協議對任何仲裁請求涉及之任何其他當事人亦有適用，包括但不限於任何陪同人、關係人及/或受豁免方。若本仲裁協議與仲裁機構或仲裁人規則之間有任何歧異，應以本仲裁協議為準。
縱令本合約有任何其他約定，持票人及WBCI成員均得行使任何合法之權利以尋求臨時救濟，而不會因此拋棄仲裁權利。縱令本合約有任何其他約定，若上述團體訴訟權利之拋棄及禁止團體仲裁之約定，被認定為無效或無法執行，則仲裁協議整體將成為無效。若本仲裁協議中拋棄團體訴訟權利及禁止團體仲裁以外的任何約定被認定為無效或無法執行，則不應使本仲裁協議之其餘部分成為無效。本仲裁協議將於本合約終止、本活動終了及/或一方破產或成為無支付能力後繼續有效（於適用法律許可範圍內）。
您有權拒絕接受本仲裁協議，但您必須立即行使此權利。若您不同意受本仲裁協議之拘束，您必須於本活動日期後三十（30）日內郵寄書面異議來通知我們。您必須將您的請求寄至：World Baseball Classic, Inc.；收件人：法務部門；主旨：票務仲裁；地址：1271 Avenue of the Americas, New York, NY 10020。該請求必須記載您的全名、地址及「本人拒絕接受活動票券所載仲裁協議」之聲明。若您行使拒絕仲裁之權利，本合約之其他條款仍應完全有效，如同您未拒絕仲裁一般。

注意事項
所有活動時間均可能進行變更。WBCI成員不對票券之滅失、遭竊或複製負責。
請於本活動結束前保留本票券。本票券如遇滅失、遭竊或損毀恕不補發。本票券僅適用本活動，持票人不得因為沒有在本活動使用本票券而請求退還任何購票價金。若本活動沒有舉行或完成，而WBCI依其全權酌情選擇於活動場館重新安排或繼續本活動（或其任何部分）（下稱「改期活動」），本票券允許持票人於改期活動之日期與時間參加改期活動，改期活動將依據WBCI全權酌情決定並公告於/world-baseball-classic。持票人不得因為沒有在改期活動使用本票券而請求退還任何購票價金。
若本活動（或其任何部分）(a) 被取消，且未於活動場館重新安排舉行；(b) 未進行至或超過官方棒球規則（Official Baseball Rule）第7.01條所載構成正規比賽（下稱「正規比賽」）之時間點，且未於活動場館繼續進行；或 (c) 在沒有觀眾或僅有有限觀眾出席的情況下進行，WBCI成員將依其全權酌情決定是否退款，並將決定公告於/world-baseball-classic。
若本活動進展至或超過構成正規比賽之時間點，將不予退款。
