GROUP HOSPITALITY AGREEMENT
Hospitality PoliciesTHIS CINCINNATI REDS GROUP TICKETHOLDER AGREEMENT (the "Agreement") is entered into between the purchaser of Cincinnati Reds hospitality area and group tickets ("Account Holder") and The Cincinnati Reds LLC (the "Reds"). By purchasing Cincinnati Reds hospitality area and group ticket(s) (a "Ticket" or collectively, the "Tickets"), and in consideration of the promises and mutual covenants herein, and for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged by the parties, the parties agree as follows:
Payment Policy for Group Tickets: Payment is due in full at the time of purchase for regular group tickets. For purchases of 50 or more tickets, a maximum of 10 tickets may be returned 30 days prior to the game for a refund.
Payment Policy for Hospitality Area; Game Tickets¡¯ Non-Refundable Deposit
Account Holder must make a non-refundable deposit (the ¡°Deposit¡±) by credit card, cashier¡¯s check or certified check equal to fifty percent (50%) of the total purchase. Within seven (7) days of the Order Date the Reds must receive the Deposit. The Deposit will be credited against the total purchase.
ALL SALES FOR HOSPITALITY AREAS AND GROUP TICKETS ARE FINAL AND ACCOUNT HOLDER IS NOT ENTITLED TO A REFUND OR EXCHANGE, EXCEPT AS SET FORTH IN GAME CANCELLATION POLICY. FURTHER, THE DEPOSIT MAY NOT BE APPLIED AGAINST OTHER PURCHASES, EXCEPT AS SET FORTH IN GAME CANCELLATION POLICY.
The balance of payment is due no later than thirty (30) days prior to the Game Date; provided, however, if the Game Date is within 30 days of the Order Date, the balance of payment must be paid and received by the Reds within seven (7) days of the Order Date or the Game Date, whichever is earlier.
Included in the total payment is a cost allocable to food and beverage service. The final cost of the food and beverage service depends upon the menu items selected by Account Holder. The cost of ¡°standard¡± food and beverage service ranges from $38 per Ballpark patron to $66 per Ballpark patron. The cost of standard food and beverage service does not include Add-on Menu Items (defined in Food and Beverages section of this Agreement).
Food and Beverages.
No food or beverages may be brought into or be prepared or consumed in the Hospitality Area other than those items of food and beverage purchased from the third party Ballpark concessionaire, Cincinnati SportService. Food and beverage service will begin 30 minutes after the time the admission gates to the Ballpark open for Game Date patrons. Food service will be discontinued at the end of the fifth inning or four hours later, whichever comes first. Beverage service will be discontinued at the end of the eighth inning or three hours from the scheduled start of the game, whichever comes first.
Account Holder may pre-order certain additional menu items (collectively, ¡°Add-on Menu Items¡±) and those Add-on Menu Items will arrive after the scheduled start of the Game. Add-on Menu Items are subject to sales tax and an 18% gratuity. Beverage service will be discontinued at the end of the eighth inning or three hours from the scheduled start of the game, whichever comes first.
The sale and consumption of alcoholic beverages is subject to Ohio law. An individual must be 21 years old to consume alcoholic beverages in the Ballpark. The Reds and/or Cincinnati SportService reserve the right to refuse service of alcohol to any person.
Unless the Game is cancelled prior to the time admission gates are opened for the Game Date, all food and beverage service will begin as scheduled and Account Holder shall be responsible for the cost of the food and beverage service.
Account Holder's Agreement.
Account Holder shall reimburse the Reds for the repair of any damage caused to the Hospitality Area or property located therein by Account Holder or any of Account Holder's invitees. Account Holder shall promptly notify the Reds of any damage occurring to the Hospitality Area or the necessity for any repairs to the Hospitality Area.
(APPLIES TO CENTERFIELD PAVILION ONLY) Account Holder acknowledges and agrees that exterior shades in the Centerfield Pavilion may obscure and obstruct field view of guests who are located inside the Centerfield Pavilion. MLB Rules mandate that the shades must be down through the 3rd inning for all evening (6:40PM or 7:10PM) games. It is in the purview of the game umpires¡¯ discretion to require that the exterior shades remain lowered throughout the game. If the Centerfield Pavilion exterior shades have been lowered they must remain in that position until a Reds¡¯ or Ballpark Manager attendant raises the exterior shades and Account Holder agree that no member of Account Holder¡¯s party shall attempt to open the shades.
Game Cancellation Policy.
If a game is canceled on the Game Date and the cancellation occurs prior to the time Ballpark patrons are permitted to enter the Ballpark (i.e., gates opening), Account Holder and the Reds shall use good faith efforts to identify a mutually agreeable ¡°make-up¡± Game Date for the cancelled game (the ¡°Rain Date¡±). If Account Holder and the Reds are unable to identify a mutually agreed upon Rain Date Account Holder shall be entitled to a full refund of all amounts paid pursuant to Payment Policy for Hospitality Area; Game Tickets¡¯ Non-Refundable Deposit and Food and Beverages sections of this Agreement. The Reds shall pay to Account Holder the refund within thirty (30) days of Account Holder¡¯s written request for such refund.
If Ballpark patrons are permitted to enter the Ballpark and the Game is cancelled prior to completion of five innings of play, Account Holder and the Reds shall use good faith efforts to identify a Rain Date. Account Holder remains obligated for the cost of food and beverage service provided on the original Game Date. If the parties are able to identify a mutually agreeable Rain Date, Account Holder acknowledges and agrees that Account Holder shall be responsible for all food and beverage service associated with the game played on the Rain Date. If Account Holder and the Reds are unable to identify a mutually agreed upon Rain Date, Account Holder shall be entitled to a refund of amounts paid pursuant to Payment Policy for Hospitality Area Fee; Game Tickets¡¯ Non-Refundable Deposit and Food and Beverages sections of this Agreement; provided, however, if Ballpark patrons are permitted to enter the Ballpark then Account Holder is not entitled to a refund of the License Fee allocable to the cost of food and beverage service provided on the original Game Date and the Reds may deduct the cost of food and beverage service provided on the original Game Date from the refund amount. The Reds shall pay to Account Holder the refund within thirty (30) days of Account Holder¡¯s written request for such refund.Alcohol Policy: The sale and consumption of all alcoholic beverages is subject to Ohio law. It is unlawful for persons under 21 years of age to purchase, consume, possess or transport alcoholic beverages. The Reds and its concessionaire will implement measures to ensure that alcoholic beverage are not accessible or served to persons under 21 years of age or to persons who are intoxicated. The Reds reserve the right to limit consumption and/or sale of alcoholic beverages at events.
Ticket Cancellation and Resell Policy: The Cincinnati Reds reserve the right to decline, reject, and/or cancel any purchase or purchaser for any reason in the Reds' sole discretion, including but not limited to, purchases not made in accordance with the Reds' applicable ticket sales policies, the terms and conditions applicable to ticket packages and ticket purchases of certain types, and the terms and conditions printed on the back of each ticket. The Cincinnati Reds also reserve the right to cancel any ticket or ticket package purchase and refund the purchase price paid for any violation of any Reds ticket sales policy, term, or condition, as determined in the Reds' sole reasonable discretion. The Cincinnati Reds also reserve the right not to sell to, and to cancel any purchase made by, individuals or companies whose intent is to resell tickets.
