Roger Dean Chevrolet Stadium Ticket Terms and Conditions

By using this ticket, ticket holder ("Holder"), on behalf of himself/herself and any minor(s) accompanying Holder ("Minors"), agrees to the terms and conditions contained in the Roger Dean Chevrolet Stadium Ticket Terms & Conditions available at www.rogerdeanchevroletstadium.com/ticketterms (the "Agreement"), and available at the Roger Dean Chevrolet Stadium box office or by calling 561-630-1828 to request a copy. Those terms and conditions are expressly incorporated by reference herein and will control if there is any conflict with the terms hereof. Licensee is admitted to Roger Dean Chevrolet Stadium or other applicable venue (collectively, the "Venue") by Jupiter Stadium, Ltd. ("JSL"), the Venue operator, for the game, tour, performance or other event for which the ticket grants Licensee admission (as applicable, the "Event") on condition of Licensee's agreement to the terms of the Agreement, a summary of which follows.

Holder, on behalf of himself/herself and Minors, agrees that JSL, JS Stadium, Inc., Jupiter Hammerheads Baseball Club, Inc., Palm Beach Cardinals, LLC, Marlins Teamco LLC, Marlins Funding LLC, Marlins Holdings LLC, St. Louis Cardinals, LLC, Major League Baseball, Minor League Baseball, Palm Beach County, and the ticket manufacturer and/or provider, and their respective past, present, and future licensees, sponsors, vendors and all of their successors and assigns, players, managers, coaches, employees, partners, members, directors, officers, owners, agents, representatives, independent contractors, and affiliates of each of the foregoing entities (collectively, the "Released Parties"), will not be responsible for any personal injury (including death), property damage, or other loss suffered in connection with the Event and/or the negligence of any of the Released Parties. Holder, on behalf of himself/herself and Minors, releases the Released Parties from any and all claims which Holder or Minors has or may have for any other cause of action arising out of attendance at, observation of, and/or participation in the Event.

Holder, on behalf of himself/herself and Minors, acknowledges and assumes all risks and dangers arising from, incidental to or related in any way to the game of baseball and/or attending, observing and/or participating in the Event, whether occurring prior to, during or subsequent to the Event, including, without limitation, the risks of lost, stolen or damaged property, personal injury or death. Such risks being assumed by Holder specifically include the danger of being injured by thrown bats, bat fragments, thrown or batted balls, thrown, dropped, or launched items, projectiles, persons, animals, other hazards or distractions, and any incidents, accidents or transmission of disease associated with crowds of people or the negligence or misconduct of INHERENT RISK OF EXPOSURE TO COVID-19 AND OTHER COMMUNICABLE DISEASE EXISTS IN ANY PUBLIC PLACE REGARDLESS OF PRECAUTIONS THAT MAY BE TAKEN. HOLDER ASSUMES ALL RISKS ASSOCIATED WITH COVID-19 AND OTHER INFECTIOUS AND/OR COMMUNICABLE DISEASES, VIRUSES, BACTERIA OR ILLNESSES. HOLDER, ON HOLDER'S BEHALF AND ON BEHALF OF ANY ACCOMPANYING PARTIES, AGREES TO (1) ASSUME ALL RISKS ASSOCIATED WITH COVID-19 AND OTHER COMMUNICABLE DISEASES, AND (2) COMPLY WITH ALL RELATED HEALTH AND SAFETY POLICIES OF JSL.

BY ATTENDING THE EVENT, HOLDER IS DEEMED TO HAVE GIVEN A FULL RELEASE OF LIABILITY, ON BEHALF OF HIMSELF/HERSELF AND MINORS, TO THE RELEASED PARTIES TO THE FULLEST EXTENT PERMITTED BY LAW.

HOLDER IS DEEMED TO HAVE GIVEN ALL OF THE FOREGOING GRANTS OF RIGHTS, RELEASES AND WAIVERS ON BEHALF OF MINORS. IF HOLDER DOES NOT WISH TO OR IS NOT AUTHORIZED TO GRANT SUCH RIGHTS, RELEASES AND WAIVERS ON BEHALF OF MINORS, HOLDER SHOULD IMMEDIATELY LEAVE THE EVENT WITH THE MINORS.

NOTICE: Retain this ticket until the Event is over. This ticket cannot be replaced if lost, stolen or destroyed. If the Event ends early and is not a regulation game, JSL will determine in its sole discretion whether any refunds will be issued and post such decision at www.rogerdeanchevroletstadium.com.

This ticket is a revocable license, revocable in the sole discretion of JSL, and only grants entry into the ballpark and a spectator seat/standing room (as applicable) for the specified game. JSL reserves the right to terminate the license granted by this ticket and/or those of Minors by tendering to Holder the purchase price printed on this ticket and/or those of Minors. Further, JSL reserves the right, without refund of any portion of the purchase price, to revoke the license granted by this ticket and/or those of Minors and refuse admission or eject any person: (a) who violates the terms of the Agreement or any of the rules, restrictions, or policies of JSL; (b) who appears to be or is intoxicated; (c) whose conduct is deemed by JSL to be improper, disorderly, or unbecoming; or (d) who uses vulgar or abusive language.

Holder, on behalf of himself/herself and Minors, agrees that neither Holder nor Minors will transmit any images of or information about the Event. Holder, on behalf of himself/herself and Minors, consents to and waives compensation for the Released Parties' use of Holder's images, images of Minors, or other personality rights of Holder or Minors, including but not limited to any rights created or recognized by ¡ì540.08, Florida Statutes. The rights granted to the Released Parties in this section are assignable. Holder, on behalf of himself/herself and Minors, agrees that Holder and Minors will obey the rules and policies of Roger Dean Chevrolet Stadium (posted at www.rogerdeanchevroletstadium.com). Holder, on behalf of himself/herself and Minors, consents to security searches and/or screening and waives all related claims.

ALL EVENT TIMES ARE SUBJECT TO CHANGE.

Holder, on behalf of himself/herself and Minors, assumes all risks associated with the purchase of this ticket or Minors' tickets from anyone other than JSL or its designated agents. Any resale of this ticket or Minors' tickets in violation of applicable law will invalidate the license granted by such ticket.

ANY DISPUTE, CLAIM, OR CAUSE OF ACTION ARISING OUT OF OR IN ANY WAY RELATED TO THIS AGREEMENT, INCLUDING BUT NOT LIMITED TO HOLDER'S OR MINORS' ATTENDANCE AND/OR PARTICIPATION AT THE EVENT, SHALL BE SETTLED BY MANDATORY, CONFIDENTIAL, FINAL, AND BINDING ARBITRATION. THE ARBITRATION SHALL BE HELD IN MIAMI, FLORIDA, AND ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION IN ACCORDANCE WITH ITS THEN-EXISTING COMMERCIAL ARBITRATION RULES. THERE SHALL BE A SINGLE ARBITRATOR TO BE SELECTED IN ACCORDANCE WITH THOSE RULES. NEITHER HOLDER, MINORS, NOR JSL SHALL BE ENTITLED TO JOIN OR CONSOLIDATE CLAIMS IN ARBITRATION BY OR AGAINST OTHER INDIVIDUALS OR ENTITIES, OR ARBITRATE AS A REPRESENTATIVE MEMBER OF A PUTATIVE CLASS OR IN A PRIVATE ATTORNEY GENERAL CAPACITY. HOLDER, ON BEHALF OF HOLDER AND ANY MINOR(S), AGREE TO WAIVE THE RIGHT TO A COURT OR JURY TRIAL. ALL DISPUTES SHALL BE ARBITRATED ON AN INDIVIDUAL BASIS, AND NOT AS A CLASS ACTION, REPRESENTATIVE ACTION, CLASS ARBITRATION, OR ANY SIMILAR PROCEEDING.

IMPORTANT: THIS TICKET IS A REVOCABLE LICENSE; USER ACCEPTS RISK OF INJURY; NO RE-ENTRY UPON EXIT; THIS TICKET LIMITS USER'S LEGAL RIGHTS

NOTICE TO THE MINOR CHILD'S NATURAL GUARDIAN

READ THIS AGREEMENT COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF RELEASED PARTIES USE REASONABLE CARE IN PROVIDING THE EVEN, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY ATTENDING THE EVENT BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE EVENT WHICH CANNOT BE AVOIDED OR ELIMINATED. BY ENTERING THE VENUE YOU ARE ACCEPTING THE TERMS AND CONDITIONS OF THIS AGREEMENT AND YOU ARE GIVING UP YOUR CHILD'S RIGHT AND YOUR RIGHT TO RECOVER FROM RELEASED PARTIES IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE EVENT. YOU HAVE THE RIGHT TO REFUSE THE TERMS AND CONDITIONS OF THIS AGREEMENT BY NOT PERMITTING YOUR CHILD ENTRY TO THE VENUE.
