IMPORTANT TERMS AND CONDITIONS
GENERAL TERMS AND CONDITIONS
This ticket is a non-renewable, revocable license granted by Pittsburgh Associates (the ¡°Pirates¡±) to allow the ticket holder (¡°Holder¡±) to enter PNC Park (including surrounding areas and parking lots, the ¡°Facility¡±) and observe the game or event identified on the ticket (the ¡°Event¡±). By using the ticket, Holder, on his/her behalf and on behalf of any accompanying minor(s) and any other accompanying party for whom Holder retains a ticket to attend the Event with Holder (each of whom Holder represents have authorized Holder to act on their behalf in accepting the applicable ticket terms) (together with accompanying minor(s), ¡°Accompanying Parties¡±), agrees to the terms and conditions below and on the Pirates¡¯ website at www.mlb.com/pirates/tickets/ticket-back-terms-conditions, any applicable Major League Baseball rules and the guest conduct standards available at www.pirates.com/a-z, which are incorporated herein by reference (collectively, the ¡°Agreement¡±). This license may be terminated without compensation if Holder violates the Agreement, or for any reason, in the Pirates¡¯ sole discretion, by refunding the price on the face of the ticket to the original purchaser. The Pirates reserve the right to change the terms and conditions of the Agreement at any time by posting changes on the Pirates¡¯ website. Holder is solely responsible for reading and understanding the Agreement before using this ticket and/or those of Accompanying Parties.
This license may be terminated without compensation if the ticket is resold in violation of the Agreement or applicable law. The ticket cannot be replaced if lost, stolen or destroyed. Tickets obtained from sources other than the Pirates or Tickets.com could be lost or stolen. Holders of lost or stolen tickets will not be admitted to the Event.
Holder, on his/her behalf and on behalf of any Accompanying Parties, consents to manual or electronic inspection of his/her person and personal property at any time inside the Facility. Holder may be denied entry or ejected from the Event if Holder is found to be in possession of any potentially dangerous, hazardous, inappropriate or injurious objects. Such objects may also be confiscated. Holder may not bring any glass bottles, cans or alcoholic beverages inside the Facility. Trespassing, disrupting the Event or attempting physical contact with a participant will be prosecuted to the fullest extent of the law.
Holder, on his/her behalf and on behalf of any Accompanying Parties, agrees not to transmit or aid in transmitting any description, account, picture, video or audio of the Event (including pre- and post-Event activities). The Pirates are the exclusive owner of all intellectual property associated with the Event.
Holder, on his/her behalf and on behalf of any Accompanying Parties, grants the Pirates and their designees the unrestricted, worldwide right and license in perpetuity to use Holder¡¯s and any Accompanying Party¡¯s image, likeness, name, voice, comments, and/or other proprietary or public rights in any media taken before, during or after an Event without compensation or further authorization.
ASSUMPTION OF RISK AND RELEASE
Holder, on his/her behalf and on behalf of any Accompanying Parties, assumes all risk and danger incidental to the Event, occurring in and around any part of the Facility, at any time prior to, during or subsequent to the Event (including, but not limited to, injuries from balls, bats or other objects entering the stands, including objects projected into the stands for entertainment purposes). Holder, on his/her behalf and on behalf of any Accompanying Parties, waives and releases any claim that the Pirates, PNC Park, the Sports & Exhibition Authority of Pittsburgh and Allegheny County, the Officer of the Commissioner of Baseball, the Major League Baseball Clubs, each of their respective affiliates, and each of their respective shareholders, partners, members, directors, officers, employees, agents, representatives, sponsors, contractors, vendors and operators are liable or responsible for losses or injuries to person or property arising from or related in any way to Holder¡¯s or any Accompanying Party¡¯s use of this ticket or attendance at an Event. Please stay alert and be aware of your surroundings.
MANDATORY ARBITRATION AGREEMENT; CLASS ACTION AND JURY TRIAL WAIVER (¡°ARBITRATION AGREEMENT¡±)
The Pirates care deeply about maintaining good relationships with fans. If Holder and/or any Accompanying Party has a problem with this ticket or the Event, a telephone call to customer service may resolve the matter quickly and amicably. Any dispute not resolved informally must be resolved in accordance with this Arbitration Agreement.
Unless prohibited by federal law, Holder and/or any Accompanying Party and the Pirates agree to arbitrate any and all claims or disputes relating in any way to Holder¡¯s and/or any Accompanying Party¡¯s purchase, sale or use of this ticket, Holder¡¯s and/or any Accompanying Party¡¯s attendance at and/or participation in the Event, the Agreement and any related dealings between them, including, without limitation, claims of illness, bodily injury or property damage arising out of Holder¡¯s and/or any Accompanying Party¡¯s attendance at and/or participation in the Event (¡°Claims¡±), except for Claims concerning the validity, scope or enforceability of this Arbitration Agreement, through BINDING INDIVIDUAL ARBITRATION. This Arbitration Agreement involves interstate commerce and shall be governed by the Federal Arbitration Act, 9 U.S.C. ¡ì¡ì 1-16 (the ¡°FAA¡±), and not by state law.
In any Claim to be resolved by arbitration, neither Holder and/or any Accompanying Party nor the Pirates will be able to have a court or jury trial or participate in a class action or class arbitration. Other rights that Holder and/or any Accompanying Party and the Pirates would have in court will not be available or will be more limited in arbitration, including the right to appeal. Holder and/or any Accompanying Party and the Pirates each understand and agree that by requiring each other to resolve all disputes through individual arbitration, EACH IS WAIVING THE RIGHT TO A COURT OR JURY TRIAL. ALL DISPUTES SHALL BE ARBITRATED ON AN INDIVIDUAL BASIS, AND NOT AS A CLASS ACTION, REPRESENTATIVE ACTION, CLASS ARBITRATION OR ANY SIMILAR PROCEEDING. The arbitrator(s) may not consolidate the claims of multiple parties without the express written consent of all parties.
Arbitrations shall be administered by the American Arbitration Association (¡°AAA¡±) pursuant to the applicable AAA rules in effect at the time the arbitration is initiated. Information about arbitration, arbitration procedures and fees may be obtained from AAA by calling 800-778-7879 or visiting www.adr.org. If AAA is unable or unwilling to arbitrate a dispute, then the dispute may be referred to any other arbitration organization or arbitrator that the parties agree upon in writing or that is appointed by a court with jurisdiction pursuant to Section 5 of the FAA. The arbitration shall take place in Pittsburgh, Pennsylvania. The arbitration shall be presided over by a single arbitrator, who shall be selected in accordance with the rules that, as specified above, shall govern the arbitration. The arbitrator shall be authorized to award any relief that would have been available in court in an individual action under Pennsylvania law, provided that the arbitrator¡¯s authority is limited to Holder and/or any Accompanying Party and the Pirates alone, except as otherwise specifically stated herein. No arbitration decision will have any preclusive effect as to non-parties. The arbitrator¡¯s decision shall be final and binding. The parties agree that this Arbitration Agreement extends to any other parties involved in any Claims. This Arbitration Agreement shall take precedence over the rules of the arbitration organization or arbitrator in the event of any conflict.
The Pirates will be responsible for paying all arbitration fees other than the amount of filing fees Holder and/or any Accompanying Party would have incurred in the state or federal court located in Pittsburgh, Pennsylvania, whichever is less. Notwithstanding any other provision herein, Holder and/or any Accompanying Party and the Pirates may seek relief in an Allegheny County Magisterial District Court for Claims within its jurisdiction. In addition, Holder and/or any Accompanying Party and the Pirates each may exercise any lawful rights to seek provisional remedies or self-help, without waiving the right to arbitrate by doing so. Notwithstanding any other provision of the Agreement, if the foregoing class action waiver and prohibition against class arbitration is determined to be invalid or unenforceable, then this entire Arbitration Agreement shall be void. If any portion of this Arbitration Agreement other than the class action waiver and prohibition against class arbitration is deemed invalid or unenforceable, it shall not invalidate the remaining portions of this Arbitration Agreement. This Arbitration Agreement will survive the termination of the Agreement, the conclusion of the Event and/or the bankruptcy or insolvency of a party (to the extent permitted by applicable law).
Prior to bringing a Claim under this Arbitration Agreement, the claimant shall give the other party or parties written notice of the Claim (a ¡°Claim Notice¡±) and a reasonable opportunity, not less than thirty (30) days, to resolve the Claim. Any Claim Notice to the Pirates shall be sent by mail to Pittsburgh Pirates, Attn: Legal Department, Re: Ticket Claim Notice, 115 Federal Street, Pittsburgh, PA 15212. Any Claim Notice must (a) identify the claimant by name, address, email address and telephone number, (b) explain the nature of the Claim and the relief demanded, and (c) be submitted only on behalf of the claimant, and not on behalf of any other party. The claimant must reasonably cooperate in providing any information about the Claim that the other party reasonably requests and must give the other party a reasonable opportunity to respond to the demand for relief.
HOLDER AND/OR ANY ACCOMPANYING PARTY HAS THE RIGHT TO REJECT THIS ARBITRATION AGREEMENT, BUT HOLDER AND/OR ANY ACCOMPANYING PARTY MUST EXERCISE THIS RIGHT PROMPTLY AS SET FORTH BELOW. If Holder and/or any Accompanying Party does not wish to be bound by this Arbitration Agreement, Holder and/or the Accompanying Party must notify the Pirates in writing within thirty (30) days after the date of the Event. Requests must be sent to Pittsburgh Pirates, Attn: Legal Department, 115 Federal Street, Pittsburgh, PA 15212, and include Holder¡¯s and/or the Accompanying Party¡¯s name, address, email address, telephone number and the statement ¡°I reject the Arbitration Agreement contained in the Pittsburgh Pirates 2025 Ticket Back Terms and Conditions.¡± If Holder and/or any Accompanying Party exercises its right to reject arbitration, the other terms of the Agreement shall remain in full force and effect as if Holder and/or the Accompanying Party had not rejected arbitration.
IF MINOR(S) AND/OR OTHER ACCOMPANYING PARTIES ATTEND THE EVENT WITH HOLDER, HOLDER IS DEEMED TO HAVE AGREED TO THIS ARBITRATION AGREEMENT ON BEHALF OF: (A) SUCH MINOR(S) AS THEIR PARENT OR GUARDIAN OR AS THE AUTHORIZED AGENT OF THEIR PARENT OR GUARDIAN; AND/OR (B) OTHER ACCOMPANYING PARTIES, AS THEIR AUTHORIZED AGENT. IF HOLDER DOES NOT WISH TO OR IS NOT AUTHORIZED TO MAKE SUCH AGREEMENT ON BEHALF OF: (I) ANY MINOR, HOLDER SHOULD IMMEDIATELY LEAVE THE FACILITY WITH THOSE MINOR(S); AND/OR (II) ANY OTHER ACCOMPANYING PARTY, SUCH ACCOMPANYING PARTY SHOULD IMMEDIATELY LEAVE THE FACILITY.

If an Event is not completed on the scheduled date/time, the exchange policy is available on the Pirates¡¯ website at www.pirates.com/raincheck. Information is also available by calling 1-800-BUY-BUCS or by visiting the PNC Park Ticket Office. Please retain this ticket stub as it will need to be presented at the time of exchange.

AN INHERENT RISK OF EXPOSURE TO COVID-19 AND OTHER COMMUNICABLE DISEASES EXISTS IN ANY PUBLIC PLACE REGARDLESS OF PRECAUTIONS THAT MAY BE TAKEN. HOLDER, ON HIS/HER BEHALF AND ON BEHALF OF ANY ACCOMPANYING PARTIES, AGREES TO (1) ASSUME ALL RISKS ASSOCIATED WITH COVID-19 AND OTHER COMMUNICABLE DISEASES, AND (2) COMPLY WITH ALL RELATED HEALTH & SAFETY POLICIES OF THE PIRATES AND THE FACILITY.
